{"data":{"id":"us-ky/krs-224.1-460","jurisdiction":"us-ky","citation":"KRS 224.1-460","heading":"Letter -- Contents -- Issuance.","body":"(1) Any public entity may apply to the cabinet to obtain a No Further Remediation\nLetter, created by KRS 224.1 -465, for a property. The application shall contain the\nfollowing information:\n(a) A legal description of the property;\n(b) A copy of the deed for the property;\n(c) An environmental site assessment of the site sufficient to characterize the\nextent of any contamination of the site;\n(d) A proposed plan to remediate the environmental contamination upon the site;\nand\n(e) The proposed use of the property int ended by the public entity after obtaining\nthe No Further Remediation Letter.\n(2) Upon receipt of an application from a public entity for a No Further Remediation\nLetter, the cabinet may approve the application, and upon the expiration of a period\nfor publ ic comment on the application deny the application, or enter into\nnegotiations with the public entity to modify the proposed remediation plan to make\nit acceptable to the cabinet. If the public entity and the cabinet negotiate an\nagreement on the proposed remediation plan, the cabinet shall approve the amended\napplication.\n(3) When the cabinet approves the remediation plan the public entity shall undertake or\ncause to be undertaken the actions required by the plan.\n(4) Upon satisfactory completion of the ap proved remediation plan the cabinet shall\nissue the No Further Remediation Letter, which is created by KRS 224.1-465, to the\npublic entity.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41596","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"755726658bc8d086048fe2073808b4ec01a4279c9f7fa1ec44ef3aff90f56c34","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-455","next":"us-ky/krs-224.1-465"},"notice":"GroundRules: Original legal text.
