{"data":{"id":"us-ky/krs-224.1-524","jurisdiction":"us-ky","citation":"KRS 224.1-524","heading":"Notification to local governments and public of proposed corrective","body":"action plan -- Comment period -- Public hearing.\n(1) Within ten (10) days from the date the applicant submits a corrective action plan to\nthe cabinet, the applicant shall:\n(a) Submit for publication in a newspaper of general circulation in the county or\ncounties where the property is located, a notice requesting public comment on\nthe corrective action plan, and submit to the cabinet a copy of the notice as\npublished, within ten (10) days of its publication. The public notice shall also\ncontain a reference to the local public library where pertinent documents\nrelated to the corrective action plan may be found;\n(b) Notify local government units affected by the remediation of the provisions of\nthe corrective action plan; and\n(c) Until the corrective action plan has been approved by the cabinet, post a sign\non the property stating that a corrective action plan for remediation of the site\nis undergoing review by the cabinet and, if a pproved, remediation will be\nconducted in accordance with the approved plan. The sign shall also provide\ninformation on where and when the corrective action plan is available for\npublic review and comment.\n(2) A comment period of at least thirty (30) days shall follow publication of the notice.\nDuring the comment period, any person may submit written comments to the\ncabinet concerning the corrective action plan and may request a public hearing. The\ncabinet may hold a public hearing if the request is made.\n(3) The cabinet may hold a public hearing in any geographical area affected by the\nremediation on the question of whether to approve or deny the corrective action\nplan.\n(4) The cabinet shall consider all written comments and public testimony prior to taking\nany action.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47775","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"5b3b6a517bd1fc79bdcab62b6018fc4f764aefd10609eb6c5560a70ace4309ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-522","next":"us-ky/krs-224.1-526"},"notice":"GroundRules: Original legal text.
