{"data":{"id":"us-ky/krs-224.1-530","jurisdiction":"us-ky","citation":"KRS 224.1-530","heading":"Screening levels relating to remediation -- Tiered remediation","body":"management -- Administrative regulations.\n(1) Notwithstanding any provision of law or administrative regulation to the contrary,\nthe numerical values contained in the most current versio n of the document titled\n\"Regional Screening Level (RSL) Table\" published by the United States\nEnvironmental Protection Agency's Region 3 as of June 8, 2011, are hereby\nestablished as screening levels and shall be used by the cabinet in conformance with\nthe guidance set out in the Risk -Based Concentration Table User's Guide. It is not\nthe intent of this section to establish these levels as the cleanup standards for\nindividual contaminants that may be present at any site.\n(2) Within one (1) year from June 21 , 2001, the cabinet shall promulgate regulations\nestablishing standards under KRS 224.1 -400 and 224.1 -405 with respect to\nhazardous substances, pollutants, contaminants, petroleum, or petroleum products,\nthat are protective of human health, safety, and the environment.\n(3) Within one (1) year from June 21, 2001, the cabinet shall promulgate a regulation\ndefining tiered remediation management options that account for the following:\n(a) Current and proposed land use;\n(b) Zoning, if applicable, of the property and surrounding properties; and\n(c) The nature and extent of the contamination.\n(4) The cabinet may promulgate administrative regulations that adopt and incorporate\nupdated versions of the Regional Screening Level (RSL) Table to be used under this\nsection.\n(5) Nothing in this section shall affect or impair the ability of the cabinet to implement\nand enforce the provisions of KRS 224.1-400 and 224.1-405.\n(6) Nothing in this section shall be construed to limit the options available to the\napplicant under KRS 224.1-400(18) to 224.1-400(21).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"20908b9b2ff265b67221d28d89c560d2bb6491b85a6b382dba511e14e823bce3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.1-528","next":"us-ky/krs-224.1-532"},"notice":"GroundRules: Original legal text.
