{"data":{"id":"us-ky/krs-224.10-105","jurisdiction":"us-ky","citation":"KRS 224.10-105","heading":"Additional powers of cabinet as to solid waste management.","body":"In addition to its other powers, the cabinet shall have the following powers:\n(1) In cooperation with waste management districts, area development districts, or\ncounties, to determine what entities are required to submit a solid waste\nmanagement plan;\n(2) To review, approve, disapprove, develop upon failure to receive, and require\namendment of solid waste management plans. A plan shall be approved if it meets\nrequirements specified by KRS Chapters 109 and 224, and administrative\nregulations adopted by the c abinet, and if it is consistent with the statewide solid\nwaste reduction and management plan;\n(3) To issue, continue in effect, revoke, modify, suspend, deny, or condition permits for\nmunicipal solid waste management facilities as necessary to implement an y\nprovisions of KRS Chapter 224, administrative regulations adopted by the cabinet,\nthe area solid waste management plan or the statewide solid waste reduction and\nmanagement plan, or applicable zoning regulations adopted pursuant to KRS\nChapter 100, or pending approval of the plans, to meet solid waste disposal capacity\nneeds of the area and to assure disposal capacity for solid waste generated in\nKentucky;\n(4) To limit the amount, by weight or volume, of waste that may be accepted for\ndisposal by municipa l solid waste facilities in the Commonwealth, consistent with\nthe requirements of KRS Chapter 224 and administrative regulations adopted by the\ncabinet, to implement provisions of the statewide solid waste reduction and\nmanagement plan, or the area solid w aste management plan, or as otherwise\nnecessary to assure capacity for disposal of waste generated in the Commonwealth\nor to protect the environment and the health and welfare of the citizens of the\nCommonwealth. The cabinet may take into account such factors as:\n(a) Operation of the facility in accordance with the most stringent standards\nadopted in administrative regulations pursuant to KRS Chapter 224;\n(b) The nature of any groundwater or surface water problems associated with\noperation of the facility;\n(c) The need for the facility to serve the solid waste management needs of the\narea in which the facility is located;\n(d) The nature of any existing contracts for disposal held by the facility; and\n(e) The compliance history of the facility;\n(5) To take an y actions consistent with KRS Chapter 224, administrative regulations\nadopted by the cabinet, the statewide solid waste reduction and management plan,\nand the area solid waste management plan as reasonably necessary to assure that\nthere is sufficient capac ity for disposal of waste generated in the Commonwealth\nand the solid waste management area, and to protect the environment and the health\nand welfare of the citizens of the Commonwealth; and\n(6) To disapprove a grant or loan for a municipal solid waste ma nagement facility\nwhich is not consistent with the statewide waste reduction and management plan or\nthe area solid waste management plan.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10309","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"2dba6051c9796d0dab47bdcb4fea0e9ca12bdce8b00368543770219bcf8b69c1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.10-103","next":"us-ky/krs-224.10-110"},"notice":"GroundRules: Original legal text.
