{"data":{"id":"us-ky/krs-224.10-225","jurisdiction":"us-ky","citation":"KRS 224.10-225","heading":"Facilitation of permits for coal -fired electric generation plants,","body":"industrial energy facilities, and surface coal mining and reclamation\noperations.\n(1) The secretary of the Energy and Environment Cabinet shall facilitate the permitting\nof:\n(a) Coal-fired electric generation plants or industrial energy facilities in the\nCommonwealth; and\n(b) Upon request of the applicant, surface coal mining and reclamation operations\nin the Commonwealth;\nby developing procedures for one (1) stop shopping for environmental permits.\n(2) Upon request by an applicant for environmental permits for an industrial energy\nfacility or a surface coal mining and reclamation operation, the secretary, in\nconsultation with the applicant, shall establish specific time per iods for actions to\nbe taken in the consideration of its permit applications. The time periods established\nshall not exceed those adopted by administrative regulations promulgated pursuant\nto KRS 224.10-220. Notwithstanding KRS 224.10 -420(2), failure by th e cabinet to\nadhere to the time periods established pursuant to this section or established by\nadministrative regulations promulgated pursuant to KRS 224.10 -220 shall\nconstitute the making of a final determination of the cabinet, and the applicant, at its\nelection, may:\n(a) Initiate an action for mandamus, declaratory judgment, or other specific relief\nin the Circuit Court for the county in which the surface coal mining and\nreclamation operation is located; or\n(b) Initiate an administrative hearing under KRS 224.10-420(2).\n(3) As used in this section, \"surface coal mining and reclamation operations\" has the\nsame meaning as in KRS 350.010.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54020","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"744971ca3ddccc73f6ac4cc2e64a93d29ee145aba8a501a97ce01246e886dc9d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.10-220","next":"us-ky/krs-224.10-230"},"notice":"GroundRules: Original legal text.
