{"data":{"id":"us-ky/krs-224.10-280","jurisdiction":"us-ky","citation":"KRS 224.10-280","heading":"Cumulative environmental assessment and fee required before","body":"construction of facility for generating electricity -- Conditions imposed by\ncabinet -- Administrative regulations.\n(1) Except for a person that commenced construction of a facility prior to April 15,\n2002, or that has received a certificate of public convenience and necessity from the\nPublic Service Commission prior to April 15, 2002, no person shall commence to\nconstruct a facility to be used for the generation of electricity unless the person:\n(a) Submits a cumulative environmental assessment to the cabinet with the permit\napplication; and\n(b) Remits a fee set pursuant to KRS 224.10 -100(20) by the cabinet to defray the\ncost of processing the cumulative environmental assessment.\n(2) The person may submit and the cabinet may accept documentation of compliance\nwith the National Environmental Policy Act (NEPA) as satisfying the requirements\nto file a cumulative environmental assessment under subsection (1) of this section.\n(3) The cumulative e nvironmental assessment shall contain a description, with\nappropriate analytical support, of:\n(a) For air pollutants:\n1. Types and quantities of air pollutants that will be emitted from the\nfacility; and\n2. A description of the methods to be used to control those emissions;\n(b) For water pollutants:\n1. Types and quantities of water pollutants that will be discharged from the\nfacility into the waters of the Commonwealth; and\n2. A description of the methods to be used to control those discharges;\n(c) For wastes:\n1. Types and quantities of wastes that will be generated by the facility; and\n2. A description of the methods to be used to manage and dispose of such\nwastes; and\n(d) For water withdrawal:\n1. Identification of the source and volume of anticipated water withdrawal\nneeded to support facility construction and operations; and\n2. A description of the methods to be used for managing water usage and\nwithdrawal.\n(4) The cabinet may impose such conditio ns regarding the timing, volume, duration, or\ntype of pollutants on a permit, registration, general permit, or permit -by-rule for a\nfacility subject to this section as are necessary to comply with applicable standards.\n(5) The cabinet may promulgate administrative regulations to implement the provisions\nof this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10323","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"d49aa49c99d1502631f3a0835354e87960764da4c36744df8d2860d02947bdf1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.10-275","next":"us-ky/krs-224.10-285"},"notice":"GroundRules: Original legal text.
