{"data":{"id":"us-ky/krs-224.10-470","jurisdiction":"us-ky","citation":"KRS 224.10-470","heading":"Appeals from final orders of the cabinet.","body":"(1) Appeals may be taken from all final orders of the Energy and Environment Cabinet.\nExcept as provided in subsection (3) of this section, the appeal shall be taken to the\nFranklin Circuit Court within thirty (30) days from entry of the final order. The\nparty or parties affected by the final order shall file in the Circuit Court a petition\nwhich states fully the grounds upon which a review is sought and assign all errors\nrelied on. The cabinet shall be named respondent, and service shall be had on the\nsecretary. Summons shall issue upon the petition directing the cabinet to send its\nentire record, properly bound, to the clerk of the Circuit Court after certifying that\nsuch record is its entire original record or a true copy thereof, which shall be filed\nby the clerk of the Circuit Court and such record shall then become official and be\nconsidered by the Circuit Court on the review. After the case has been properly\ndocketed in the Circuit Court, any party directly affected by the issues on appeal,\nmay, upon notice to the parties and upon proper showing and in the discretion of the\ncourt be permitted to intervene. Upon hearing of the appeal the findings of the\ncabinet shall be prima facie evidence of the facts found therein. The court shall\nreview the entire record and the findings and final order of the cabinet.\n(2) Appeals to the Court of Appeals from orders of the Circuit Court, shall be taken in\nthe manner provided in the Kentucky Rules of Civil Procedure.\n(3) Final orders of the cabinet regarding environmental permits for an industrial energy\nfacility as defined in KRS 224.1 -010 shall be subject to expedited review by the\nCircuit Court located in the county where the industrial energy facility is proposed\nto be located.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10328","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"cc048e17b843df9b2542bef2df7334f339f19492b49607d33d191b5066f2c8dc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.10-440","next":"us-ky/krs-224.10-610"},"notice":"GroundRules: Original legal text.
