{"data":{"id":"us-ky/krs-224.10-650","jurisdiction":"us-ky","citation":"KRS 224.10-650","heading":"Source separation and collection program for waste materials -- Use of","body":"funds received -- Resource conservation and recovery fund.\n(1) The secretary of the Energy and Environment Cabinet shall assume the primary\nresponsibility in state government fo r implementing a source separation and\ncollection program for waste materials generated as a result of state agency\noperations, including, at a minimum, aluminum, high grade office paper, and\ncorrugated paper.\n(2) The cabinet shall establish procedures for  collection and storage of recovered\nmaterial and contractual or other arrangements for transportation and purchase of\nrecovered materials. Every state agency of the executive, legislative, and judicial\nbranches of state government and all state -supported institutions of higher\neducation, in cooperation with the cabinet, shall develop a plan to conduct source\nseparation and collection activities for recovered materials.\n(3) A state agency or institution may elect to operate its own source separation program\nupon review and approval by the cabinet.\n(4) The secretary of the Energy and Environment Cabinet shall take or cause to be\ntaken such actions as may be necessary to:\n(a) Identify the geographical location of existing or potential markets for\nrecovered materials and energy generated;\n(b) Identify the economic and technical barriers to the use of recovered materials\nand energy generated;\n(c) Identify sound technologies, techniques, and processes for resource recovery\nand energy generated applicable to both urban and rural areas of Kentucky;\n(d) Encourage the development of new uses for recovered materials; and\n(e) Encourage and promote the development of new markets for recovered\nmaterials.\n(5) Funds received by the Energy and Environment Cabinet from the sou rce separation\nand collection program as described in this section shall be utilized by the cabinet to\ndefray the cost of conducting the activities outlined in this section. Funds received\nby any other state agency or institution from an approved source se paration\ncollection program may be used to offset costs of the program. Any moneys\ngenerated by the cabinet or other state agencies or institutions in excess of the\namounts needed to conduct these activities shall be placed in the resource\nconservation and recovery fund and be used for other litter abatement activities.\n(6) There is created within the State Treasury a trust and agency fund, which shall not\nlapse, to be known as the resource conservation and recovery fund. Any\nappropriations, gifts, grants or program revenues received by the cabinet relating to\nresource recovery and litter abatement shall be deposited in the fund.
