{"data":{"id":"us-ky/krs-224.16-080","jurisdiction":"us-ky","citation":"KRS 224.16-080","heading":"Change or extinguishment of assignment of mixing zone for","body":"bioaccumulative chemicals of concern -- Required information for permit\nmodification or renewal.\n(1) In accordance with the water quality standards established in 401 KAR 10:029 in\neffect on March 24, 2021, which were submitted to and deemed approved by the\nUnited States Environmental Protection Agency pursuant to its 2018 triennial\nreview of Kentucky's water quality standards under 33 U.S.C. sec. 1313(c), any\nmixing zone for a bioac cumulative chemical of concern assigned by the cabinet on\nor before September 8, 2004, shall be in effect from that date unless and until\nexplicitly changed or extinguished by the cabinet after March 24, 2021. Any\nKentucky Pollutant Discharge Elimination System permittee who seeks to rely on a\nmixing zone for a bioaccumulative chemical of concern assigned by the cabinet on\nor before September 8, 2004, shall include information identifying the mixing zone\nin any application for the modification or renewal of  the relevant Kentucky\nPollutant Discharge Elimination System permit.\n(2) Any change or extinguishment in mixing zone assignments for bioaccumulative\nchemicals of concern by the cabinet pursuant to subsection (1) of this section shall\nonly be accomplished through a formal Kentucky Pollutant Discharge Elimination\nSystem permitting action by the cabinet, including public notice and opportunity for\ncomment, conducted pursuant to administrative regulations promulgated in\naccordance with KRS Chapter 13A.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:39Z","sha256":"4077cf7d3f8debefe4f7344b8a489e52ba6974127323db363c48b2f077c473fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.16-070","next":"us-ky/krs-224.16-090"},"notice":"GroundRules: Original legal text.
