{"data":{"id":"us-ky/krs-224.20-145","jurisdiction":"us-ky","citation":"KRS 224.20-145","heading":"Conditions under which cabinet may propose or submit a plan","body":"establishing carbon dioxide emission reduction performance standards for\nexisting fossil fuel-fired electric generating units -- Administrative regulations -\n- Conditions under which performance standards plan is a legal nullity.\n(1) The cabinet shall not propose or submit to the United States Environmental\nProtection Agency any plan establishing performance standards for existing fossil\nfuel-fired electric generating units unless the plan is:\n(a) Consistent with KRS 224.20-140 to 224.20-146; and\n(b) Prepared in consultation with the Kentucky Public Service Commission to\nensure that the plan:\n1. Minimizes the impacts on current and future industrial, commercial, and\nresidential consumers; and\n2. Does not threaten the affordability of Kentucky's rates or the reliability\nof electricity service.\n(2) The cabinet shall promulgate administrative regulations for the establishment and\nimplementation of any state plan to regulate emissions of carbon d ioxide emissions\nfrom existing fossil fuel -fired electric generating units under 42 U.S.C. sec.\n7411(d).\n(3) Any state plan established by the cabinet to regulate emissions of carbon dioxide\npursuant to KRS 224.20-140 to 224.20-146 shall have no legal effect if:\n(a) The United States Environmental Protection Agency:\n1.  Fails to issue federal rules or guidelines for reducing carbon dioxide\nemissions from existing fossil fuel -fired electric generating units under\n42 U.S.C. sec. 7411(d); or\n2. Withdraws its f ederal rules or guidelines for reducing carbon dioxide\nemissions from existing fossil fuel-fired electric generating units; or\n(b) A court of competent jurisdiction invalidates the United States Environmental\nProtection Agency's federal rules or guidelines issued to regulate emissions of\ncarbon dioxide from existing fossil fuel-fired electric generating units.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43014","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"773c4bc0f91e64cbc17497c4b96dd9f07929c3819177bc3228fa981259e71038","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.20-144","next":"us-ky/krs-224.20-146"},"notice":"GroundRules: Original legal text.
