{"data":{"id":"us-ky/krs-224.20-710","jurisdiction":"us-ky","citation":"KRS 224.20-710","heading":"Definitions for KRS 224.20-710 to 224.20-765.","body":"As used in KRS 224.20-710 to 224.20-765, unless the context clearly indicates otherwise:\n(1) \"Compliance certificate\" means an official emission inspection certificate issued by\nthe cabinet or a county, air pollution control district, contractor, or fleet operator\nauthorized by the cabinet, indicating that a vehicle has been tested in accordance\nwith KRS 224.20 -710 to 224.20 -765 and complies with all applicable emission\nstandards;\n(2) \"Independent contractor\" means any person, business firm, partnership, or\ncorporation with whom the cabinet or a fiscal court may negotiate an agreement\nproviding for construction, equipment, maintenance, personnel, management, and\noperation of an official emission inspection station;\n(3) \"Control system\" means equipment designed for installation or installed on a motor\nvehicle for the purpose of reducing the air contaminants emitted from the vehicle or\na system or engine adjustment or modification which causes a reduction of air\ncontaminants emitted from the vehicle;\n(4) \"Exemption certificate\" means an official exemption certificate issued by the\ncabinet or a county, contractor, or fleet operator authorized by the cabinet,\nindicating that a vehicle is exempt from certain requirements of KRS 224.20 -710 to\n224.20-765;\n(5) \"Inspection station\" means an official vehicle emission inspection facility whether\nplaced in a permanent structure or in a mobile unit for conveyance among various\nlocations within this Commonwealth, to conduct emission inspections of vehicles\nrequired to be inspected pursuant to KRS 224.20-710 to 224.20-765;\n(6) \"Reciprocal certificate\" means an official certificate issued by the cabinet or a\ncounty, air pollution control district, contractor, or fleet operator authorized by the\ncabinet, honoring an out-of-state certificate that indicates the vehicle was tested and\neither successfully passed the inspection or was exempt from the inspection in a\nstate that is required to conduct vehicle emission testing by the Federal\nEnvironmental Protection Agency. A reciprocal certificate shall be valid for one (1)\nyear from the date it is issued;\n(7) \"Vehicle\" means any automobile or truck registered in this Commonwealth having a\ncombined manufacturer's weight of vehicle and maximum load to be carried of up\nto eighteen thousand  (18,000) pounds, which is equivalent to eight thousand one\nhundred eighty-two (8,182) kilograms, or less and used upon the public highways of\nthe Commonwealth for the purpose of transporting persons or property. The term\n\"vehicle\" shall not include a motorcycle, as defined in KRS 189.285(6); and\n(8) \"Vehicle emission control program\" means a program developed by the cabinet\npursuant to KRS 224.20 -710 to 224.20 -765 which provides for the control of\nvehicle emissions of any air contaminant.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10363","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"aee2cad9f245c630e4368033560bc97ca2104ca3873cf7249e875027d8b082b0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.20-515","next":"us-ky/krs-224.20-715"},"notice":"GroundRules: Original legal text.
