{"data":{"id":"us-ky/krs-224.20-740","jurisdiction":"us-ky","citation":"KRS 224.20-740","heading":"Vehicle emission inspection stations.","body":"(1) The cabinet may enter into an agreement with one (1) or more independent\ncontractors, subject to public bidding, to provide for the construction, equipment,\nestablishment, maintenance, and operation of official vehicle emission inspection\nstations in the numbers and locations required to provide vehicle owners reasonably\nconvenient access to inspection facilities.\n(2) The cabinet shall be prohibited from entering into an agreement with any\nindependent contractor who is engaged in the business of manufacturi ng, selling,\nmaintaining or repairing vehicles and vehicle replacement or repair parts in the\nCommonwealth, except that the independent contractor shall not be precluded from\nmaintaining or repairing any vehicle owned or operated by the independent\ncontractor.\n(3) The agreement authorized by this section shall contain provisions relating to the\nfollowing:\n(a) That the Commonwealth shall not be required to purchase any asset or assume\nany liability if the agreement is not renewed;\n(b) That the contractor is authorized to collect the inspection fee for a test in the\namount fixed by the cabinet;\n(c) That the Commonwealth shall be reimbursed by the contractor for not less\nthan ten percent (10%) of the inspection fee, except for programs operated by\nair pollution control districts;\n(d) That reports and documentation shall be submitted to the cabinet if required\nconcerning the operation of the official vehicle emission inspection stations;\nand\n(e) That the cabinet has discretion to investigate the operation of the official\nvehicle emission inspection stations as the conditions and circumstances of\nthe operation may indicate, and that the cabinet may revoke the contract if it\nfinds that the stations are not operated in accordance with KRS 224.20 -710 to\n224.20-765 or that the contractor has failed or refused to submit records or\ndocumentation required by KRS 224.20-710 to 224.20-765.\n(4) The agreement may contain any provisions deemed necessary by the cabinet for the\nadministration or enforcement of KRS 224.20-710 to 224.20-765.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10370","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"f3aef7c1a538b27aa57a00844fd4e15e6daf4bf181bb8314659d9a5d5327cb72","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.20-735","next":"us-ky/krs-224.20-745"},"notice":"GroundRules: Original legal text.
