{"data":{"id":"us-ky/krs-224.20-760","jurisdiction":"us-ky","citation":"KRS 224.20-760","heading":"Effect of KRS 224.20 -710 to 224.20 -765 on KRS Chapters 77 and 224","body":"provisions -- Prohibition against inspection of motorcycles -- Reciprocal\ncertificates.\n(1) Except as provided in subsections (2), (3), and (4) of this section, the provisions of\nKRS 224.20-710 to 224.20 -765 shall not detract from the authority provided air\npollution control districts in KRS Chapters 77 and 224.\n(2) Any air pollution control district that has received authority to operate a vehicle\nemission control program shall be pr ohibited from inspecting motorcycles as\ndefined in KRS 189.285(6). The provisions of this subsection shall supersede any\nexisting local ordinance involving the inspection of motorcycles under a vehicle\nemission control program administered by an air pollut ion control district. All\ncounties, cities, special districts, and other units of local government, including an\nair pollution control district, shall be prohibited from enacting an ordinance contrary\nto the provisions of this subsection.\n(3) Any air pollu tion control district that has received authority to operate a vehicle\nemission control program shall honor and issue reciprocal certificates as required\nunder KRS 224.20 -717. The provisions of this subsection shall supersede any\nexisting local ordinance i nvolving the inspection of motor vehicles under a vehicle\nemission control program administered by an air pollution control district. All\ncounties, cities, special districts, and other units of local government shall be\nprohibited from enacting an ordinance contrary to the provisions of this subsection.\n(4) The authority in KRS 224.20 -720 is provided to air pollution control districts\nprovided:\n(a) The air pollution control district may function and exercise its powers\npursuant to resolution or ordinance as  provided in this section, KRS 186.180,\n186.290, 186.990, and 224.20-765, and KRS Chapter 77; and\n(b) The air pollution control district has been granted concurrent jurisdiction by\nthe cabinet pursuant to KRS 224.20-130.\n(5) Actions taken by an air polluti on control district for violations of KRS 224.20 -710\nto 224.20-765 shall be enforced in accordance with the provisions of KRS 224.20 -\n130(5).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10374","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"405c822d25d224bb2b31b88f9a78429b7de57489ce746b1d45b5e438073b88e5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.20-755","next":"us-ky/krs-224.20-765"},"notice":"GroundRules: Original legal text.
