{"data":{"id":"us-ky/krs-224.43-010","jurisdiction":"us-ky","citation":"KRS 224.43-010","heading":"Policy and purpose -- Priorities for solid waste management practices --","body":"Findings relating to solid waste management plans.\n(1) It is hereby declared to be the policy of this Commonwealth and the purpose of this\nchapter to provide for the managemen t of solid waste, including reduction,\ncollection, transportation, and disposal in a manner that will protect the public\nhealth and welfare, prevent the spread of disease and creation of nuisances,\nconserve our natural resources, and enhance the beauty and  quality of our\nenvironment.\n(2) It is the policy of the Commonwealth to limit and reduce the amount of solid waste\ndisposed in municipal solid waste disposal facilities in the Commonwealth through\nreduction in the amount of waste generated, reuse of solid  waste, waste recycling or\nyard waste composting, and resource recovery, and to encourage a regional\napproach to solid waste management.\n(3) It is the policy of the Commonwealth that municipal solid waste disposal facilities\nthat ceased accepting waste bef ore July 1, 1992, undergo proper closure,\ncharacterization, and corrective action.\n(4) It is the policy of the Commonwealth that a comprehensive and integrated waste\nmanagement system to handle solid waste is to be fostered. State policies and\nfunding assi stance shall reflect a preference for projects and practices consistent\nwith the policies and goals established by this section and the following:\n(a) Education of the citizens of the Commonwealth regarding proper disposal of\nwaste;\n(b) Collection and proper disposal of all of solid waste for proper management;\n(c) Elimination of illegal dumps throughout the Commonwealth; and\n(d) Abatement of litter on state and county rights-of-way.\n(5) It is the policy of the Commonwealth that existing illegal open dumps be eliminated\nand that new open dumps be prevented.\n(6) The General Assembly finds that counties and waste management districts, when\nenabled by complete and accurate information relating to the municipal solid waste\ncollection and management practices wit hin the solid waste management area, are\nin the best position to make plans for municipal solid waste collection services for\nits citizens. The General Assembly also finds that assistance from the cabinet,\ncombined with state financial incentives, can aid counties and waste management\ndistricts with implementing solid waste management plans.\n(7) The General Assembly finds that the goal of reducing the amount of solid waste\ndisposed of in municipal solid waste disposal facilities cannot be achieved without\nfirst identifying the amount of municipal solid waste generated statewide per capita,\nincluding the waste now disposed of in open dumps, and providing incentives for\nthe elimination of existing open dumps and the prevention of new open dumps.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10409","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"f833c02d7214dde487737553fdac19323ed7d6a5eae144a6f8ee46c2d16723ff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.420","next":"us-ky/krs-224.43-020"},"notice":"GroundRules: Original legal text.
