{"data":{"id":"us-ky/krs-224.43-335","jurisdiction":"us-ky","citation":"KRS 224.43-335","heading":"Requirement of creation of manifest system -- Contents of manifest --","body":"Reporting -- Necessity of manifest for acceptance of waste.\nIn order to assist in solid waste planning and management, to further the goals of waste\nreduction and recycling, and to assist in identification of parties in the event of\nenvironmental problems arising from the transport or disposal of the waste, the cabinet\nshall adopt administrative regulations creating a manifest system which shall require that\neach shipment of waste  received at a municipal solid waste disposal facility or transfer\nfacility be accompanied by written documentation in a form determined by the cabinet.\nThe manifest shall identify the geographic source or sources of the waste, by county, city,\nand state; contain a description of the types of waste contained in the shipment; list the\nnames and addresses of each transporter of the waste; and list the names and addresses of\neach solid waste management facility which handled the waste; and each broker who\narranged or contracted for the transportation or disposal of the waste. Each municipal\nsolid waste disposal facility shall indicate on the manifest the amount of waste by weight\nreceived from each transporter, and each transfer facility shall indicate on the manifest the\namount of waste by weight received from each transporter and the amount of waste\nshipped from the facility for handling or disposal in Kentucky. The manifest shall provide\na certification by each person named in the manifest that while the wast e was in his\ncustody or control no waste regulated by the cabinet as hazardous waste or infectious\nwaste was knowingly introduced into the waste. A copy of each manifest shall be\nmaintained at the municipal solid waste disposal facility and any transfer facility handling\nthe waste, and shall be open to inspection by representatives of the cabinet, shall be\ntransmitted to the cabinet on a quarterly basis, and shall be considered nonexempt records\navailable for public inspection. Ninety (90) days after the ef fective date of the initial\nadministrative regulations adopted by the cabinet to effectuate this section, no municipal\nsolid waste disposal facility or transfer facility shall accept waste unless it is accompanied\nby a manifest.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10418","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"0f297b1fdb139732864c15b50a9c437341adae671052d3eb7188b55237d56a76","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.43-330","next":"us-ky/krs-224.43-340"},"notice":"GroundRules: Original legal text.
