{"data":{"id":"us-ky/krs-224.43-360","jurisdiction":"us-ky","citation":"KRS 224.43-360","heading":"Limitation on increases in amount of waste accepted -- Exceptions --","body":"Revision of limitation by cabinet.\n(1) Consistent with requirements of KRS Chapter 224, increases in the amount of waste\nfrom any geographic source permitted to be accepted by any  municipal solid waste\ndisposal facility shall not exceed more than five percent (5%) of the average volume\nof waste accepted during the twelve (12) month period January 1990 through\nDecember 1990 unless:\n(a) The facility has been constructed in accordance  with the most stringent\ncontainment standards effective January 1, 1991; or\n(b) The facility meets a design standard of at least twelve (12) inches of soil with\na maximum permeability of one (1) times ten (10) to the minus seven (7)\npower centimeters per second or its equivalent, has a leachate collection\nsystem installed in a manner approved by the cabinet, and has a groundwater\nmonitoring system approved by the cabinet.\nA municipal solid waste disposal facility meeting the requirements of subsection\n(1)(b) of this section shall not accept waste for disposal after July 1, 1995, unless it\nmeets the most stringent containment standards effective January 1, 1991.\n(2) The cabinet shall revise upward or downward the limitation contained in subsection\n(1) of this section if it determines that the revision is necessary to be consistent with\nthe statewide solid waste reduction and management plan or the area solid waste\nmanagement plan; to assure capacity for disposal of solid waste generated in\nKentucky; to assur e capacity for disposal of industrial solid waste generated in\nKentucky as the result of economic development; to protect against risks to health,\nwelfare, or the environment; or to allow a solid waste disposal facility to accept\nthose wastes it is required to accept by a contract executed before October 1, 1990.\n(3) The provisions of this section shall be incorporated in the permits of solid waste\ndisposal facilities to which it applies not designed in accordance with the most\nstringent containment standards adopted by the cabinet for these facilities.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10422","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"f4d9fcd012ce88acd428d44b99676e1ea900070226422cbc9a69e5f8be899b3d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.43-352","next":"us-ky/krs-224.43-370"},"notice":"GroundRules: Original legal text.
