{"data":{"id":"us-ky/krs-224.43-380","jurisdiction":"us-ky","citation":"KRS 224.43-380","heading":"Consent to service of transporters of out -of-state waste --","body":"Documentation -- Filing -- Effect.\n(1) No person shall transport or cause to be transported from outside the\nCommonwealth to a municipal solid waste management facility in the\nCommonwealth any waste unless each of the following persons, if not a resident of\nthe Commonwealth at the time the waste is transported, has first irrevocably\nconsented in writing to the jurisdiction of the courts of the Commonwealth and\nservice of process in the Comm onwealth, including summons and subpoenas, for\nany civil or criminal proceeding arising out of or relating to the waste that is\nshipped to a facility in this state:\n(a) Any person who actually transports the waste;\n(b) The employer of the person who actually transports the waste;\n(c) Any person acting as a broker or otherwise arranging or contracting for the\ntransportation of the waste, with the exception of persons initially generating\nmunicipal solid waste; and\n(d) Any person who has contracted with the o wner or operator of the facility for\nmanagement of the waste at that facility.\n(2) The original of the consent -to-service document shall be filed with the cabinet. A\ncopy shall be filed with the owner or operator of each municipal solid waste\nmanagement facility to which the waste is transported. The original and each copy\nshall be sent by certified mail, return receipt requested, at least seven (7) days\nbefore the first shipment of waste to a waste site or facility in the Commonwealth in\nthe year for which  the document is filed. The document shall be updated to reflect\nany changes in circumstances and refiled.\n(3) A person who enters the Commonwealth pursuant to a summons, subpoena, or\nother form of process authorized by this section is not subject to servi ce of process\nin connection with nonrelated matters that arise before his entrance into the\nCommonwealth.\n(4) No owner, operator, or employee of a municipal solid waste management facility\nshall accept for treatment, transfer, storage, or disposal at the f acility any waste\nfrom outside the boundaries of the Commonwealth unless a copy of the consent -to-\nservice document required by this section and applicable to the waste is on file at\nthe facility.\n(5) The owner or operator of a municipal solid waste managem ent facility shall keep\nthe consent-to-service documents filed with him under this section at the facility in\nsuch a location and manner that they are readily accessible to the cabinet.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10424","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"bea41f3da7c009bb600c1272cf3ef8436ded75e56a5f4067d163fbc31b331d29","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.43-370","next":"us-ky/krs-224.43-500"},"notice":"GroundRules: Original legal text.
