{"data":{"id":"us-ky/krs-224.43-500","jurisdiction":"us-ky","citation":"KRS 224.43-500","heading":"Environmental remediation fee to be paid by generators of waste --","body":"Conversion formula -- Report.\n(1) As used in this section:\n(a) \"Environmental remediation fee\" means a one dollar and seventy -five cents\n($1.75) fee paid per ton of waste by generat ors of waste and collected at\ntransfer stations and waste disposal facilities that is in addition to all other\napplicable fees and taxes assessed prior to January 1, 2003;\n(b) \"Transfer station\" means a facility permitted by the cabinet where waste is\ntransferred from one (1) vehicle to another for transportation to a municipal\nsolid waste disposal facility; and\n(c) \"Public road\" means any city, county, state, federal, or limited access street,\nhighway, or turnpike, including bridges and bridge approaches.\n(2) The environmental remediation fee levied under this section is in addition to all\nother applicable fees and taxes assessed prior to January 1, 2003. Notwithstanding\nany law, franchise, or contract to the contrary, the owner or operator of a transfer\nstation or municipal solid waste disposal facility, or the person who collects waste\nand delivers such waste to a transfer station or municipal solid waste disposal\nfacility may pass through and obtain from the generator any environmental\nremediation fee required under this section.\n(3) The environmental remediation fee shall be paid by generators of waste to be\ndisposed of at a municipal solid waste disposal facility and collected by waste\ntransfer stations or municipal solid waste disposal facilities in the  Commonwealth.\nNo environmental remediation fee shall be collected at a municipal solid waste\ndisposal facility on waste for which the fee has been paid at a transfer station to the\ndisposal facility. The cabinet shall, by administrative regulation, adopt a conversion\nformula to allow assessment of the fee by transfer stations that do not have scales.\nFor loads of waste weighing less than one (1) ton, the environmental remediation\nfee shall be one dollar and seventy-five cents ($1.75).\n(4) Not later than thirty (30) days following the last day of each calendar quarter, every\nowner or operator of a transfer station or municipal solid waste disposal facility\nshall remit to the cabinet the environmental remediation fee collected during the\nprior quarter, with a  report stating the number of tons of waste for which the\nenvironmental remediation fee was collected.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10425","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:40Z","sha256":"ba9f1e5d207b264f54ed50b518ded4c05b216fdd78c065e0d841543df6a6bed2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.43-380","next":"us-ky/krs-224.43-505"},"notice":"GroundRules: Original legal text.
