{"data":{"id":"us-ky/krs-224.43-810","jurisdiction":"us-ky","citation":"KRS 224.43-810","heading":"Policy declaration.","body":"(1) It shall be the policy of the Commonwealth of Kentucky to encourage and promote\nthe establishment of a regional integrated waste treatment and disposal\ndemonstration facility which utilizes efficient, environmentally acceptable and\ncommercially feasible te chnologies, techniques, and processes for maximizing\nresource recovery and energy generation from the treatment and disposal of\nhazardous waste in Kentucky and minimizing land disposal.\n(2) This policy may be implemented by contracts and agreements with th e federal\ngovernment and its agencies and with other organizations, including private\nindustry, and through organizations that may be formed jointly by the state, the\nfederal government or its agencies, and private industry to establish a regional\nintegrated waste treatment and disposal demonstration facility in such\norganizational form or legal entity deemed appropriate by the participants.\n(3) This policy may be implemented by the expenditure of state funds for the\npreliminary engineering and planning, de sign, construction and operation of a\nregional integrated waste treatment and disposal demonstration facility project in\nKentucky, and for the acquisition and improvement of land, construction of roads,\nand provision of other public facilities incidental a nd necessary to the\naccomplishment of this project in Kentucky.\n(4) This policy may be implemented by the sale of state property to organizations\nengaged in a regional integrated waste treatment and disposal demonstration facility\nproject in Kentucky, either for a fair and reasonable consideration or solely or partly\nas all or a portion of the state's participation in this project.\n(5) This policy may be implemented by acquisition, by purchase, or by option to\npurchase the fee simple title to, or any accept able lesser interest in such rights -of-\nway, franchises, or easements, including submerged lands and riparian rights that\nare necessary for the construction, use or operation of any authorized regional\nintegrated waste treatment and disposal demonstration f acility project and for the\nconstruction and operation of a line of railroad, truck road, overhead conveyor, or\nother transportation facilities together with the necessary rights of ingress and\negress to construct, examine, alter, repair, maintain, operate , or remove such\ntransportation facilities.\n(6) This policy may be implemented by contracts and agreements for the\nCommonwealth to purchase all or a portion of the usable output of this project,\neither for a fair and reasonable consideration or solely or partly as all or a portion of\nthe state's participation in the project, and to dispose of this output by use in state\nfacilities or by resale at fair market value.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10432","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"d42e8fdab562808d874996fd1b987afd7d6a65c0d8ec36f41f5b572edd4a990f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.43-730","next":"us-ky/krs-224.43-815"},"notice":"GroundRules: Original legal text.
