{"data":{"id":"us-ky/krs-224.46-018","jurisdiction":"us-ky","citation":"KRS 224.46-018","heading":"Fee for modification of permit to construct or operate hazardous waste","body":"treatment, storage, or disposal facility.\n(1) An applicant seeking to modify a permit to construct or operate a hazardous waste\ntreatment, storage, or disposal facility shall be  subject to a fee by the cabinet of\nthree hundred dollars ($300) if the cabinet determines that the modification is\nminor.\n(2) An applicant seeking to modify a hazardous waste treatment, storage, or disposal\nfacility permit to add one (1) or more waste str eams, and a waste stream with the\nsame characteristic is already permitted, shall be subject to a review fee of three\nhundred dollars ($300) per waste stream proposed to be added. All other applicants\nto add one (1) or more waste streams shall be subject b y the cabinet to a review fee\nequal to:\n(a) Tank: three thousand four hundred dollars ($3,400);\n(b) Surface impoundment: five thousand dollars ($5,000);\n(c) Waste pile: four thousand five hundred dollars ($4,500);\n(d) Incinerator: six thousand five hundred dollars ($6,500);\n(e) Container: two thousand seven hundred dollars ($2,700);\n(f) Land treatment: five thousand five hundred dollars ($5,500); and\n(g) Landfill: five thousand five hundred dollars ($5,500).\n(3) An applicant seeking to modify a permit to co nstruct or operate a hazardous waste\ntreatment, storage, or disposal facility shall be subject to a fee by the cabinet in the\nfollowing amounts, for the addition or substantial modification of a treatment,\nstorage, or disposal unit:\n(a) A tank with a total  capacity of seven thousand five hundred (7,500) or more\ngallons: seven thousand four hundred dollars ($7,400);\n(b) A tank with a total capacity less than seven thousand five hundred (7,500)\ngallons: three thousand seven hundred dollars ($3,700);\n(c) A container with a total capacity of five thousand (5,000) or more gallons: six\nthousand dollars ($6,000);\n(d) A container with a total capacity less than five thousand (5,000) gallons: three\nthousand dollars ($3,000);\n(e) Incinerator: nineteen thousand four hundred dollars ($19,400);\n(f) Landfill: fifteen thousand dollars ($15,000);\n(g) Land treatment: fifteen thousand eight hundred dollars ($15,800);\n(h) Waste pile: twelve thousand two hundred dollars ($12,200); and\n(i) Surface impoundment: fourteen thousand dollars ($14,000).\n(4) The incinerator fee provided in subsections (2) and (3) of this section shall apply\nonce for each different type of incinerator unit at the facility. The types of\nincinerator units shall include: liquid injection, r otary kiln, fluidized bed, and\nmultiple hearth. The tank fee provided in subsections (2) and (3) of this section\nshall apply once for each different tank design. Tank design criteria shall include:\ndifferences in materials of construction, pressure vessels , nonpressure vessels,\nshape, and ancillary equipment. The container fee provided in subsections (2) and\n(3) of this section shall apply once for each different container type. Container types\nshall include: drums, tote bins, bottles, and roll-off boxes.\n(5) An applicant seeking to modify a facility investigation or corrective action plan for\na solid waste management unit at a hazardous waste treatment, storage, or disposal\nfacility shall be subject to a fee by the cabinet, which shall be equal to the cost of\nreview but shall not exceed the following amounts for the specified instance:\n(a) Facility investigation: fourteen thousand five hundred dollars ($14,500); and\n(b) Corrective action: twenty-nine thousand dollars ($29,000).\n(6) An applicant seeking to mo dify a detection, compliance or corrective action\nprogram at a regulated unit of a hazardous waste treatment, storage, or disposal\nfacility shall be subject to a fee by the cabinet, which shall not exceed the following\namounts for each specified instance:\n(a) Change from detection to compliance monitoring: six thousand dollars\n($6,000);\n(b) Change from compliance to corrective action: eight thousand dollars ($8,000);\nand\n(c) Modification of detection, compliance, or corrective action program: five\nthousand dollars ($5,000).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10437","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"2c5efead8dcf196a00f7b0513ba1c83c5fb6c35528d35566406a1666ab5387ac","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.46-016","next":"us-ky/krs-224.46-305"},"notice":"GroundRules: Original legal text.
