{"data":{"id":"us-ky/krs-224.46-305","jurisdiction":"us-ky","citation":"KRS 224.46-305","heading":"Legislative findings and goals on pollution prevention.","body":"In the interest of protecting public health and the environment, the General Assembly of\nthe Commonwealth of Kentucky hereby finds that it is the policy of the Commonwealth\nto encourage environmental leadership in pollution prevention by source reduction w hen\ntechnically feasible and economically practicable, without shifting risks from one part of\na process or environmental medium to another. It shall be the goal of the Commonwealth\nto reduce the amount by weight of hazardous waste and of toxic chemicals r egulated\nunder Title III, Section 313 of the Superfund Amendments and Reauthorization Act of\n1986 generated by each Kentucky facility in 1987 by twenty -five percent (25%) by\nJanuary 1, 1997, and by fifty percent (50%) by January 1, 2002. It shall also be the goal of\nthe Commonwealth to reduce the amount by weight of hazardous waste, and of toxic\nchemicals regulated under Title III, Section 313 of the Superfund Amendments and\nReauthorization Act of 1986 generated by each Kentucky facility which began operati ng\nafter December 31, 1987, by twenty -five percent (25%) within ten (10) years after\nbeginning the operation, and by fifty percent (50%) within fifteen (15) years after\nbeginning the operation. The General Assembly finds that the best means to achieve\nenvironmental leadership through pollution prevention are by:\n(1) Providing facilities generating hazardous waste or releasing toxic chemicals with\ntechnical assistance to reduce the release of toxic chemicals and the generation of\nhazardous waste;\n(2) Encouraging facilities generating hazardous waste or releasing toxic chemicals to\nadopt policies to prevent pollution, to prepare comprehensive plans and to develop\nmeasurable performance goals;\n(3) Providing economic incentives to reduce the amount of hazardous waste generated\nand toxic chemicals released in the Commonwealth; and\n(4) Using cabinet incentives to acknowledge the environmental leadership of facilities\nmeeting the pollution prevention goal.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10438","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"bfed1793e7cc0127db2c3a612c8c9022e2e03e3aeefbbcc06c432702ec91a73e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.46-018","next":"us-ky/krs-224.46-310"},"notice":"GroundRules: Original legal text.
