{"data":{"id":"us-ky/krs-224.46-315","jurisdiction":"us-ky","citation":"KRS 224.46-315","heading":"Center for Pollution Prevention -- Board of directors -- Powers and","body":"duties of board.\n(1) There shall be established a Center for Pollution Prevention, which shall be a\ntechnical information and assistance office to be located at a state-owned university,\nwhich shall facilitate and promote the commercial implementation of pollution\nprevention technologies and procedures by providing technical and financial\nassistance, as available, to business and industry. The center shall be governed by a\nboard of directors representing the following organizations:\n(a) The secretary of the Energy and Environment Cabinet or a designee of the\nsecretary;\n(b) The dean of the University of Louisville School of Engineering or a designee\nof the dean;\n(c) The dean of the Un iversity of Kentucky School of Engineering or a designee\nof the dean;\n(d) A representative of the industrial community appointed by the Governor;\n(e) A representative of the environmental protection community appointed by the\nGovernor;\n(f) A representative of local government appointed by the Governor;\n(g) An environmental engineer appointed by the Governor;\n(h) An at -large member appointed by the Governor representing an industrial\nfacility;\n(i) An at -large member appointed by the Governor representing an agricultural\nproducer; and\n(j) An at-large member appointed by the Governor representing the public.\n(2) Board members may designate proxies who shall have voting privileges at board\nmeetings. The members identified in subsection (1)(a) to (1)(d) of this s ection shall\nserve as permanent members of the board. Of the six (6) members identified in\nsubsections (1)(e) to (j) of this section, two (2) shall continue in office for two (2)\nyears, two (2) shall continue in office for three (3) years, and two (2) shal l continue\nin office for four (4) years, as the Governor designates. At the expiration of the\noriginal terms and for all succeeding terms, the Governor shall appoint a successor\nto the board for three (3) years. Members may be reappointed. The Governor sha ll\nappoint a chairperson for the board.\n(3) Meetings of the board shall be held at least quarterly, but may be held more\nfrequently if necessary. The chair or a majority of members may call a special\nmeeting. Five (5) members of the board shall constitute a quorum for doing\nbusiness. Each member shall have one (1) vote and a majority vote of the members\npresent shall control on all questions. No member shall receive a salary, fee, or\nother remuneration for services as a member of the board, but each member shall be\nreimbursed for ordinary travel expenses, including meals and lodging, incurred in\nthe performance of the member's duties.\n(4) The board shall:\n(a) Formulate policies and procedures necessary to carry out the purposes stated\nin KRS 224.46-305;\n(b) Promulgate administrative regulations solely to carry out the purposes of KRS\n224.46-320 to assure the proper distribution of funds available to the center;\n(c) Review and authorize pollution prevention projects and programs to be\nundertaken and financed p ursuant to KRS 224.46 -305, 224.46 -320, 224.46 -\n330, and 224.46-580;\n(d) Review and approve all progress and final research reports on projects\nauthorized by KRS 224.46-305 and 224.46-320;\n(e) Assure that funds available to the center are not diverted to any  uses\ninconsistent with KRS 224.46 -305 to 224.46 -335 and KRS 224.46 -580, and\nthat all authorized projects are directed toward improvement of the\nenvironment, specifically toward pollution prevention and toward preserving\nand strengthening industry in Kentucky;\n(f) Provide to the Governor and the General Assembly an annual report showing\nthe status of funds appropriated for the purposes of KRS 224.46 -305 to\n224.46-335 and KRS 224.46 -580 for pollution prevention and progress of the\nboard in terms of its resea rch and pollution prevention technology\nimplementation efforts;\n(g) Advise the Governor and the General Assembly each year of the need for\ncontinuation of the center and its board through levy of the hazardous waste\nassessment fund for the purpose of financing pollution prevention programs;\n(h) Approve and release public statements relating to the progress and results of\npollution prevention programs and research;\n(i) Hire a technical advisor if deemed necessary; and\n(j) Approve the budget and expenditures of the center.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10440","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"86abcf12bdba980e578ab39a2fe7071dcb58c8db61337521e8b2cda1a4003cde","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.46-310","next":"us-ky/krs-224.46-320"},"notice":"GroundRules: Original legal text.
