{"data":{"id":"us-ky/krs-224.46-335","jurisdiction":"us-ky","citation":"KRS 224.46-335","heading":"Environmental leadership program.","body":"(1) The cabinet shall establish by administrative regulation an environmental leadership\nprogram for those facilities meeting the pollution prevention goal established in\nKRS 224.46 -305. The program shall provide incentives to acknowledge the\nenvironmental leadership of those facilities. The program may include provisions to\naddress:\n(a) Public recognition of a facility for meeting \"state of the art\" standards for\nenvironmental leadership;\n(b) Accelerated review of a facility's applications for permits, permit renewals,\nand permit modifications;\n(c) \"Green product\" labeling for products produced by a facility;\n(d) Compliance credit given in later enforcement action taken against a facility;\n(e) Reduced frequency of monitoring or reporting by a facility;\n(f) Consolidation of requirements into one (1) permit;\n(g) Reduction or elimination of fees paid to the cabinet for permits, releases of\ntoxic chemicals, or generation of hazardous waste;\n(h) Access to the Commonwealth Office of the Ombudsman who will assist in\ncutting red tape; and\n(i) Offset of voluntary actions against future regulatory requirements.\n(2) The administrative regulations shall not violate a statutory or regulatory\nrequirement or impair the cabinet's ability to administer a federally -delegated or\nfederally-funded program.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"144dd419d8e61adac7d71d1f41ff737028ee31d2883e0d3215ac0b1011c3c0b4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.46-330","next":"us-ky/krs-224.46-505"},"notice":"GroundRules: Original legal text.
