(Effective July\n15, 2026)\n(1) As used in this section and KRS 224.50-422:\n(a) \"Battery-containing product\":\n1. Means a product that contains or is packaged with a covered battery; and\n2. Does not include computers, small -scale servers, computer monitors,\nelectronic keyboards and mice, printers, fax machines, scanners,\ntelevisions, digital video disc players and recorde rs, video cassette\nrecorders, digital converter boxes, cable receivers, satellite receivers,\nportable digital music players, or video game consoles;\n(b) \"Covered battery\":\n1. Means a portable battery or a medium format battery; and\n2. Does not include a battery:\na. That is contained in a medical device regulated under the federal\nFood, Drug, and Cosmetic Act, 21 U.S.C. 301 et seq., and is not\ndesigned or marketed for sale or resale at retail locations for\npersonal use;\nb. That contains an electrolyte as a free liquid or a product that\ncontains such a battery;\nc. Designed to power a motor vehicle, part of a motor vehicle, or a\ncomponent part of a motor vehicle assembled by, or for, a vehicle\nmanufacturer or franchised dealer , including replacement parts for\nuse in a motor vehicle;\nd. In a product that is not intended or designed to be easily\nremovable from the product;\ne. Or battery -containing product that is being recalled for safety\nreasons; or\nf. Or battery-containing product offered for resale by a business that,\nas part of its operations, offers products for resale to other\nbusinesses or to consumers;\n(c) \"Medium format battery\" means:\n1. For batteries that are not capable of being recharged, a battery that\nweighs more th an four and four -tenths (4.4) pounds but not more than\ntwenty-five (25) pounds; or\n2. For rechargeable batteries, a battery that weighs more than eleven (11)\npounds or has a rating of more than three hundred (300) watt -hours, or\nboth, but that does not weigh more than twenty-five (25) pounds or have\na rating of more than two thousand (2,000) watt-hours;\n(d) \"Portable battery\" means:\n1. For batteries that are not capable of being recharged, a battery that\nweighs no more than four and four-tenths (4.4) pounds; or\n2. For rechargeable batteries, a battery that weighs no more than eleven\n(11) pounds and has a rating of no more than three hundred (300) watt -\nhours;\n(e) \"Rechargeable battery\" means a battery that contains one (1) or more voltaic\nor galvanic cells el ectrically connected to produce electric energy and that is\ndesigned to be recharged;\n(f) \"Recovery\" means the collection, accumulation, and transportation of covered\nbatteries or battery -containing products for the purpose of introducing them\ninto a recycling process; and\n(g) \"Voluntary battery stewardship organization\" means a voluntary organization\ndesignated by the cabinet to directly implement a covered battery stewardship\nplan approved by the cabinet.\n(2) Beginning on June 30, 2027, a person shall not  place or cause to be placed a\ncovered battery in a curbside, commercial front load, or roll -off container that is\nused for either solid waste disposal or recycling.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57551","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"05e44b4131800a5eb71eeef40e3e76cfd083ffdc16db4532cb1208f24df00243","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.50-413","next":"us-ky/krs-224.50-422"},"notice":"GroundRules: Original legal text.
