{"data":{"id":"us-ky/krs-224.50-422","jurisdiction":"us-ky","citation":"KRS 224.50-422","heading":"Covered Battery Stewardship Program -- Establishment -- Duties of","body":"cabinet -- Registration of voluntary battery stewardship organizations --\nSubmission of plans -- Reporting requirements.\n(1) No later than March 31, 2027, the cabinet shall establish the Covered Battery\nStewardship Program in order to:\n(a) Educate the public on the prohibition on covered battery disposal in KRS\n224.50-420;\n(b) Foster the creation of voluntary battery stewardship organizations in the\nCommonwealth;\n(c) Oversee the implementation of a voluntary take -back program for recovery of\nrechargeable covered batteries in an efficient and safe manner;\n(d) Investigate the feasibility of establishing a voluntary take -back program for\nimbedded batteries;\n(e) Promote a market for the recovery of covered batteries; and\n(f) Prevent damage to solid waste collection equipment and disposal facilities due\nto the improper disposal of covered batteries.\n(2) To facilitate the establishment of the Covered Battery Stewardship Program, the\ncabinet shall collaborate with, at a minimum, the following stakeholders or\nrepresentatives thereof:\n(a) Manufacturers, wholesalers, distributors, and retailers of covered batteries and\ncovered battery-containing products;\n(b) Material recyclers, as defined in KRS 177.905;\n(c) Solid waste collectors and solid waste disposal facilities;\n(d) Municipalities;\n(e) Counties;\n(f) Voluntary battery stewardship organizations, if any; and\n(g) Waste management districts established under KRS Chapter 109.\n(3) Once the program is established, the cabinet shall publish, update, and maintain on\nits website:\n(a) A listing of covered battery collection sites that will accept covered batteries\nfor recovery; and\n(b) Contact information for transporters that will accept covered batteries for\ntransportation to a collection site or recovery facility.\n(4) (a) To be designated as a voluntary battery stewardship organization by the\ncabinet, the registrant shal l submit its registration in the form and manner as\nthe cabinet may require. For approval, at a minimum, the registration shall\ninclude the following:\n1. The business structure of the voluntary battery stewardship organization;\n2. The names and contact inf ormation for all officers of, and participants\nin, the voluntary battery stewardship organization; and\n3. Evidence that the voluntary battery stewardship organization is currently\nin good standing with the Secretary of State.\n(b) Within ten (10) business days of receiving a complete registration, the cabinet\nshall inform the registrant that the registration is approved.\n(5) After the cabinet has approved its registration under subsection (4) of this section,\nbut before operation, a voluntary battery steward ship organization shall submit to\nthe cabinet a voluntary battery stewardship organization plan for approval or\ndisapproval, which shall contain, at a minimum:\n(a) Requirements for participating retailers of covered batteries or battery -\ncontaining products to conspicuously display on their products notice of the:\n1. Prohibition on covered battery disposal in KRS 224.50-420; and\n2. Website address maintained by the cabinet pursuant to subsection (3) of\nthis section;\n(b) Requirements for participating covered  battery manufacturers or producers to\nensure that the covered battery:\n1. Including a battery in a battery -containing product, is marked with an\nidentification of the manufacturer or producer of the battery; and\n2. Is marked to ensure proper collection an d recovery by identifying the\nchemistry of the battery and including an indication that the battery\nshould not be disposed of as household waste;\n(c) Consumer awareness goals and a description of the education and outreach\nstrategy that the voluntary battery stewardship organization will implement;\n(d) Collection site safety training procedures related to covered battery collection\nactivities at collection sites, including a description of operating protocols to\nreduce risks of spills or fires, response pro tocols in the event of a spill or fire,\nand protocols for safe management of damaged batteries that are returned to\ncollection sites;\n(e) Provisions for recordkeeping, tracking, and documenting the management and\ndisposition of collected covered batteries; and\n(f) A method for fully funding the voluntary battery stewardship organization's\nplan in a manner that equitably distributes the plan's costs among the\nmembers of the battery stewardship organization, without adding a point -of-\nsale cost or fee to the consumer.\n(6) Each voluntary battery stewardship organization shall submit to the cabinet on or\nbefore June 30, 2027, and each June 30 thereafter, a report that includes:\n(a) The weight, by chemistry, of covered batteries collected;\n(b) The weight of materials recovered from covered batteries collected, in total,\nand by method of battery recovery;\n(c) A calculation of the recovery efficiency rate;\n(d) Identification of all facilities utilized by the organization for recovery or other\nmanagement of covered batteries and battery components and a description of\nhow the facility recovered or otherwise managed covered batteries and battery\ncomponents;\n(e) The weight and chemistry, us ing approximations or actual amounts, of\ncovered batteries sent to each facility that is used for the final disposition of\nbatteries; and\n(f) A detailed description of education and outreach efforts supporting plan\nimplementation and an evaluation of the e ffectiveness of education and\noutreach activities.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57552","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"10bd6b4344babddb7d95933229931f1e305b6d4bd363a36f3e07219381469ead","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.50-420","next":"us-ky/krs-224.50-545"},"notice":"GroundRules: Original legal text.
