{"data":{"id":"us-ky/krs-224.50-585","jurisdiction":"us-ky","citation":"KRS 224.50-585","heading":"Plastic resin code labeling.","body":"(1) As used in this section:\n(a) \"Rigid plastic container\" means any formed or molded article comprised\npredominantly of plastic resin and having a relatively inflexible finite shape or\nform intended primarily as a single service container with a capacity of eight\n(8) ounces or more and less than five (5) gallons;\n(b) \"Rigid plastic bottle\" means any rigid plastic container with a neck that is\nsmaller than the container body with a capacity of sixteen (16) ounces or more\nand less than five (5) gallons; and\n(c) \"Label\" means a code label described in this section molded into the bottom of\nthe plastic product.\n(2) All rigid plastic bottles and rigid plastic containers sold in Kentucky on and after\nJanuary 1, 1992, shall be labeled with a code which indicates the resin used to\nproduce the rigid plastic bottle or rigid plastic container. The code shall consist of a\nnumber placed inside a triangle and letters placed below the triangle. The triangle\nshall be equilateral, formed by three (3) arrows with the apex of each point of the\ntriangle at the  midpoint of each arrow, rounded with a short radius. The pointer or\narrowhead of each arrow shall be at the midpoint of each side of the triangle with a\nshort gap separating the pointer from the base of the adjacent arrow. The triangle,\nformed by the thre e (3) arrows curved at their midpoints, shall depict a clockwise\npath around the code number. The numbers and letters used shall be as follows:\n1 = PETE (polyethylene terephthalate)\n2 = HDPE (high density polyethylene)\n3 = V (vinyl)\n4 = LDPE (low density polyethylene)\n5 = PP (polypropylene)\n6 = PS (polystyrene)\n7 = OTHER (represents all other resins, including layered plastics\nof a combination of materials).\n(3) A rigid plastic bottle or rigid plastic container constructed with a layer of resin or\nother plastic component made of material different from that constituting the\nprimary resin may be labeled with the code for the primary resin constituting the\nbottle or  container if the manufacturer of the container or bottle provides\ndocumentation satisfactory to the cabinet that the manufacturer has successfully\ndemonstrated and has received a letter from the Association of Postconsumer\nPlastic Recyclers (APR) confirmi ng that the bottle meets or exceeds the APR\nCritical Guidance Document and APR General Guidance Document Bottle -to-\nBottle protocol. After receipt and review of satisfactory documentation, the cabinet\nshall provide a letter of approval and designation of the resin code that may be used.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10470","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"48d8d325b7c1351f04140787d4d1b9d70ed6d7f732579827da2d4514e6dd1826","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.50-545","next":"us-ky/krs-224.50-760"},"notice":"GroundRules: Original legal text.
