{"data":{"id":"us-ky/krs-224.50-878","jurisdiction":"us-ky","citation":"KRS 224.50-878","heading":"Grant for project that manages tires -- Application -- Prioritization --","body":"Revocation.\n(1) If money in the waste tire trust fund established by KRS 224.50 -880 is not\notherwise obligated, the cabinet may award a grant to a person for a project that will\nmanage waste tires in accordance with the purposes of the waste tire program as\nappropriate to protect human health, safety, and the environment, or to develop\nmarkets for waste tires.\n(2) An applicant for a grant shall meet the following criteria:\n(a) Have the legal authority to construct and operate the project;\n(b) Have the ability to construct and operate the project in compliance with this\nchapter and the grant conditions; and\n(c) The applicant and the persons who will be managing the project shall not have\nreceived a final judgment or conviction of a state or federal environmental\nstatute or regulation in the five (5) years before submitting the application and\nshall not have any outstanding violations of state or federal environmental\nstatutes or regulations.\n(3) The cabinet shall prioritize the applications based on the following factors:\n(a) The project's consistency with the purposes of the waste tire program;\n(b) The project's costs and forecasted benefits;\n(c) The applicant's credit history; and\n(d) The applicant's and key personnel's environmental compliance record.\n(4) A person awarded a grant shall:\n(a) Construct and operate the project in compliance with this chapter and the\ngrant conditions;\n(b) Remain responsible for complying with this ch apter and the grant conditions,\neven if the project is managed by someone else;\n(c) Retain ownership of all real and personal property purchased with grant funds\nunless the cabinet approves their transfer;\n(d) Submit to the cabinet monthly an itemized list of expenditures, with copies of\ninvoices or similar documentation;\n(e) Submit to the cabinet periodic progress reports; and\n(f) Not change the project without the cabinet's approval.\n(5) The cabinet may revoke  a grant and seek recovery of any grant funds dispersed if\nthe person awarded the grant does not comply with this chapter or the grant\nconditions.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10502","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"633293c0f5d27597af0b6e4afe967972521ace78ca50c8a4e22f1e7d7421c3e6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.50-876","next":"us-ky/krs-224.50-880"},"notice":"GroundRules: Original legal text.
