{"data":{"id":"us-ky/krs-224.60-100","jurisdiction":"us-ky","citation":"KRS 224.60-100","heading":"Underground storage tanks and regulated substances defined.","body":"As used in KRS 224.60-105:\n(1) \"Underground storage tank\" means any one (1) or combination of tanks (including\nunderground pipes connected thereto) used to contain an accumulation of regulated\nsubstances, and the volume of which (including the volume of th e underground\npipes connected thereto) is ten percent (10%) or more beneath the surface of the\nground. Such term does not include any:\n(a) Farm or residential tank of one thousand one hundred (1,100) gallons or less\ncapacity used for storing motor fuel for noncommercial purposes;\n(b) Tank used for storing heating oil for consumptive use on the premises where\nstored;\n(c) Septic tank;\n(d) Pipeline facility (including gathering lines) regulated under the Natural Gas\nPipeline Safety Act of 1968, (49 U.S.C. App.  secs. 1671 et seq.), the\nHazardous Liquid Pipeline Safety Act of 1979 (49 U.S.C. App. secs. 2001 et\nseq.), or which is an intrastate pipeline facility regulated under state laws\ncomparable to the provisions of the Natural Gas Pipeline Safety Act of 1968\nor the Hazardous Liquid Pipeline Safety Act of 1979;\n(e) Surface impoundment pit, pond, or lagoon;\n(f) Storm water or waste water collection system;\n(g) Flow-through process tank;\n(h) Liquid trap or associated gathering lines directly related to oil or gas\nproduction and gathering operations; or\n(i) Storage tank situated in an underground area (such as a basement, cellar,\nmineworking, drift, shaft, or tunnel) if the storage tank is situated upon or\nabove the surface of the floor.\n(2) \"Regulated substance\" me ans any substance defined in Section 101(14) of the\nComprehensive Environmental Response, Compensation, and Liability Act of 1980,\nbut not including any substance regulated as a hazardous waste under Subtitle C,\nand petroleum, including crude oil or any fr action thereof which is liquid at\nstandard conditions of temperature and pressure (60 degrees Fahrenheit and 14.7\npounds per square inch absolute).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10504","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"e939b86fb6393096c7d597c1bfd134e49813c48c546c36c9e7ae451fcb2c0147","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.570","next":"us-ky/krs-224.60-105"},"notice":"GroundRules: Original legal text.
