{"data":{"id":"us-ky/krs-224.60-105","jurisdiction":"us-ky","citation":"KRS 224.60-105","heading":"Registration of underground storage tanks -- Program to regulate","body":"tanks.\n(1) Owners of any underground storage tank, currently existing, or taken out of\noperation after January 1, 1974, shall notify the cabinet of the existence of such\ntanks and a description of the tank and its use in accordance with regulations\npromulgated by the cabinet.\n(2) The cabinet shall regulate underground storage tanks by requiring minimum\nconstruction and performance standards, leak detection, record keeping, reporting\nreleases, corrective actions, closure, financial responsibility, and any other\nrequirement deemed necessary by the cabinet to protect the public health and\nenvironment. In promulgating regulations to carry out this section the cabinet may\ndistinguish between types, classes, and ages of underground storage tanks.\n(3) It is the intent of the General Assembly that the cabinet shall establish a program to\nregulate underground storage tanks which implements federal regulatory\nrequirements for underground storage tanks. The cabinet shall develop and\nimplement a program and promulgate administr ative regulations for underground\nstorage tanks which shall be submitted for approval to the United States\nEnvironmental Protection Agency pursuant to federal regulations.\n(4) KRS 224.60 -105 to 224.60 -160 and administrative regulations promulgated under\nauthority of KRS 224.60 -105 to 224.60 -160 shall supersede and preempt all local\nlaws, ordinances, and regulations pertaining to petroleum underground storage\ntanks, except:\n(a) Any applicable state fire marshal regulations or local building permit\nprocedures for petroleum storage tank installations;\n(b) Any local law, ordinance, or regulation promulgated before July 15, 1990; or\n(c) Any local restrictions or conditions imposed pursuant to KRS Chapter 100.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10505","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:41Z","sha256":"b1c435be62aeb36b394cda79be3e1cca162b4a27d694662dc9cb7329c50c8d31","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.60-100","next":"us-ky/krs-224.60-110"},"notice":"GroundRules: Original legal text.
