{"data":{"id":"us-ky/krs-224.60-110","jurisdiction":"us-ky","citation":"KRS 224.60-110","heading":"Legislative findings and intent.","body":"The General Assembly of the Commonwealth of Kentucky finds and declares that:\n(1) Significant quantities of petroleum and petroleum products are being stored in\npetroleum storage tanks in the state to meet the needs of its citizens and to foster\neconomic growth and development and the overall quality of life in the state;\n(2) Spills, leaks, discharges, and other releases into the environment from petroleum\nstorage tanks, however, have occurred, are occurring, or will occur, and such\nreleases may pose a threat to public health and safety and the environment;\n(3) Adequate financial resources must be readily available to provide a means for\ninvestigation and cleanup of contamination without delay;\n(4) In recent years, petroleum storage tank owners or operators have been unable to\nobtain affordable pollution liability insurance coverage to pay for corrective action\nmeasures;\n(5) It is in the best interests of the state to protect public health and safety and the\nenvironment by creating a fund for corrective actio n measures for releases into the\nenvironment from petroleum storage tanks;\n(6) Commercial insurers may increase the availability and affordability of pollution\nliability insurance coverage for petroleum storage tanks if a comprehensive and\nefficient financial responsibility program for tanks is established;\n(7) An efficient program of financial responsibility should include corrective action\nrequirements that encourage petroleum storage tank owners or operators to take\ncorrective action measures in the first instance;\n(8) An efficient program of financial responsibility for petroleum storage tanks should\nminimize disputes over the causation of and responsibility for releases into the\nenvironment from petroleum storage tanks;\n(9) An efficient program of finan cial responsibility should protect petroleum storage\ntank owners and operators from fraudulent claims against the fund to insure the\nfund's financial viability and should authorize the vigorous pursuit of fraudulent\nclaims;\n(10) It is necessary and essenti al that the state use all practical means to control or\neliminate pollution hazards posed by leaking petroleum storage tanks; and\n(11) It is the intent of the General Assembly that a state fund be created to assist\npetroleum storage tank owners or operator s in complying with the federal financial\nresponsibility requirements promulgated under federal regulations and to assist\npetroleum storage tank owners or operators in cleaning up contamination caused by\na release.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10506","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"4fa81322611a3dc463ed6b73aef4079da06376433b80e443b53e36eb38fa4c31","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.60-105","next":"us-ky/krs-224.60-115"},"notice":"GroundRules: Original legal text.
