{"data":{"id":"us-ky/krs-224.60-135","jurisdiction":"us-ky","citation":"KRS 224.60-135","heading":"Corrective action for a release into the environment from a petroleum","body":"storage tank.\n(1) As required under administrative regulations of the cabinet, a petroleum storage\ntank owner or operator shall commence, or contract for, corrective action for  a\nrelease into the environment from a petroleum storage tank. A property owner who\nis not also the petroleum storage tank owner or operator shall have no obligation to\nperform corrective action for a release into the environment from a petroleum\nstorage tank.\n(2) If a petroleum storage tank owner or operator fails or refuses to take corrective\naction, the cabinet may draw funds from the unobligated balance of the fund to\ninitiate, or contract for, corrective action pursuant to KRS 224.60 -105 to 224.60 -\n160 in accordance with subsection (3) of the section.\n(3) Except as provided in subsection (4) of this section, before initiating, or contracting\nfor, corrective action, the cabinet shall make a reasonable effort to notify and\nprovide to the petroleum storage tank owner or operator an opportunity to comply\nwith the requirements of this section.\n(4) The cabinet may draw funds from the unobligated balance of the fund to undertake,\nor contract for, corrective action necessary to prevent or remedy an emergency\nsituation threatening public health, safety, or the environment, resulting from a\nrelease into the environment from a petroleum storage tank, unless a petroleum\nstorage tank owner or operator is taking appropriate action to abate emergency\nsituations in accordance with administrative regulations of the cabinet.\n(5) Within six (6) months from April 9, 1990, the state fire marshal shall promulgate\nadministrative regulations which require any person or organization who installs,\nrepairs, closes, or removes an underground storage tank for a petroleum storage tank\nowner or operator to demonstrate financial capability, including the maintenance of\npollution liability insurance, and technical competency and proficiency.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40531","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"b16f9123187f12f31ba123e05a1fb38b402ff99290270949da2a9b827bc73441","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.60-130","next":"us-ky/krs-224.60-137"},"notice":"GroundRules: Original legal text.
