{"data":{"id":"us-ky/krs-224.60-138","jurisdiction":"us-ky","citation":"KRS 224.60-138","heading":"Reduction of contamination levels by corrective action or closure --","body":"Request for final determination -- Hearing -- Effect.\n(1) If corrective action for a release from or closure of a petroleum storage tank reduces\nlevels of contamination to less than the standards established pursuant to the\nadministrative regulations adopted under KRS 224.60 -137, then the cabinet shall\napprove the corrective action or closure and issue a notice to the owner or operator\nthat no further action is required to addres s the petroleum contamination. This\nnotice shall indicate that the property is not subject to any additional actions under\nKRS 224.1-400 or 224.1-405.\n(2) A person who submits a corrective action proposal to the cabinet may request in\nwriting a final determination on the proposal no sooner than thirty (30) days after its\nsubmission. When a final determination on the proposal is requested, the cabinet\nshall make its final determination within sixty (60) working days from the date the\nrequest is received by t he cabinet. After a final determination has been made, the\nperson requesting the final determination may request a hearing pursuant to the\nprovisions of KRS 224.10 -420. Nothing in this subsection shall relieve any person\nof any obligations imposed by law d uring an environmental emergency, nor shall it\nrequire the cabinet to approve a proposal which would violate this chapter or the\nadministrative regulations promulgated pursuant thereto.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40532","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"42e05af08ddb5086f7480a657db31163e3fb4bd3f52850e0e8434885fa265f40","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.60-137","next":"us-ky/krs-224.60-140"},"notice":"GroundRules: Original legal text.
