{"data":{"id":"us-ky/krs-224.60-155","jurisdiction":"us-ky","citation":"KRS 224.60-155","heading":"Penalty.","body":"(1) Any underground storage tank owner or operator who fails to comply with KRS\n224.60-105 or regulations promulgated thereto shall be subject to a civil penalty not\nto exceed five thousand dollars ($5,000) for each day of violation.\n(2) In determining the civ il penalty to be imposed pursuant to this section, the cabinet\nor court shall consider all relevant circumstances including, but not limited to, the\nextent of harm or potential harm caused by the violation, the nature and duration of\nthe violation, the num ber of past violations, and any corrective action taken by the\nunderground tank owner or operator.\n(3) No civil penalty may be imposed under this section if the underground storage tank\nowner or operator already has been penalized for the same violation un der federal\nregulations.\n(4) The United States Environmental Protection Agency, for purposes of collecting\ncivil penalties, is not a third -party claimant under any of the provisions of KRS\n224.60-105 to 224.60-160.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10518","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"6e219b93d1be4442a80fb09ba6199f6e94b2a23bb8e7d36f9123fe7473794db7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.60-150","next":"us-ky/krs-224.60-160"},"notice":"GroundRules: Original legal text.
