{"data":{"id":"us-ky/krs-224.71-100","jurisdiction":"us-ky","citation":"KRS 224.71-100","heading":"Definitions for KRS 224.71-100 to 224.71-140.","body":"As used in KRS 224.71-100 to 224.71-140, unless the context requires otherwise:\n(1) \"Agriculture operation\" means any farm operation on a tract of land, including all\nincome-producing improvements and farm dwellings, together with other farm\nbuildings and structures incident to the operation and maintenance of the farm,\nsituated on ten (10) contiguous acres or more of land used for the production of\nlivestock, livestock products, poultry, poultry products, milk, milk products, or\nsilviculture products, or f or the growing of crops such as, but not limited to,\ntobacco, corn, soybeans, small grains, fruit and vegetables; or devoted to and\nmeeting the requirements and qualifications for payments to agriculture programs\nunder an agreement with the state or federal government;\n(2) \"Bad actor\" means any person engaged in agriculture operations, who receives\nwritten notification of documented water pollution and of the agriculture water\nquality plan needed to prevent water pollution, and is provided technical assista nce,\nand financial assistance when possible, to implement the agriculture water quality\nplan, but still refuses or fails to comply with the requirements of the agriculture\nwater quality plan;\n(3) \"Best management practices\" means, for agriculture operation s, the most effective,\npractical, and economical means of reducing and preventing water pollution\nprovided by the United States Department of Agriculture Natural Resources\nConservation Service and the Soil and Water Conservation Commission. Best\nmanagement practices shall establish a minimum level of acceptable quality for\nplanning, siting, designing, installing, operating, and maintaining these practices;\n(4) \"Conservation plan\" means a plan, provided by the United States Department of\nAgriculture Natural Resources Conservation Service and the Soil and Water\nConservation Commission, describing best land management practices, including an\ninstallation schedule and maintenance program, which when completely\nimplemented, will improve and maintain soil, water, and related plant and animal\nresources of the land;\n(5) \"Compliance plan\" means a conservation plan containing best management\npractices developed for persons engaged in agriculture operations by the United\nStates Department of Agriculture Natural Resource s Conservation Services, in\nconjunction with local conservation districts as required for eligibility under the\nFederal Food Security Act;\n(6) \"Forest stewardship management plan\" means a plan developed by the cabinet's\nDivision of Forestry, the cabinet's Division of Conservation, the Department of Fish\nand Wildlife Resources, and the United States Department of Agriculture Natural\nResources Conservation Service which establishes practices for a person engaged in\nagriculture operations to manage forest lands in accordance with sound silvicultural\nprinciples;\n(7) \"Conservation district\" means a subdivision of state government organized pursuant\nto KRS Chapter 262 for the specific purpose of assisting persons engaged in\nagriculture operations and land users in  solving soil and water resources problems,\nsetting priorities for conservation work to be accomplished, and coordinating the\nfederal, state, and local resources to carry out these programs;\n(8) \"Groundwater\" means subsurface water occurring in the zone of  saturation beneath\nthe water table and any perched water zones below the B soil horizon;\n(9) \"Water priority protection region\" means an area specifically delineated where\nwater pollution from agriculture operations has been scientifically documented;\n(10) \"Agriculture water quality plan\" means a document incorporating the conservation\nplan, compliance plan, or forest stewardship management plan as necessary to\nprevent groundwater and surface water pollution from an agriculture operation;\n(11) \"Surface wat er\" means those waters having well -defined banks and beds, either\nconstantly or intermittently flowing; lakes and impounded waters, marshes and\nwetlands; and any subterranean waters flowing in well -defined channels and having\na demonstrable hydrologic conn ection with the surface. Effluent ditches and\nlagoons used for waste treatment which are situated on property owned, leased, or\nunder valid easement by a permitted discharger shall not be considered to be surface\nwaters of the Commonwealth;\n(12) \"Soil and Water Conservation Commission\" means the commission created in KRS\n146.090 for the purpose of administering the organization of conservation districts;\nand\n(13) \"Livestock\" means cattle, sheep, swine, goats, horses, alpacas, llamas, buffaloes, or\nany other animals of the bovine, ovine, porcine, caprine, equine, or camelid species.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48727","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"cfe18fff08df1f7afe9f77df1dc11ce13469aac89a0eb2b7f9005333aae8e110","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.70-150","next":"us-ky/krs-224.71-110"},"notice":"GroundRules: Original legal text.
