{"data":{"id":"us-ky/krs-224.71-135","jurisdiction":"us-ky","citation":"KRS 224.71-135","heading":"Confidentiality of documents relating to plans submitted by agriculture","body":"operations.\nFor purposes of KRS 224.71 -100 to 224.71 -140, any documents relating to agriculture\noperations' agriculture water quality plans, conservation plans, or forest stewa rdship\nmanagement plans, submitted to a local conservation district office or a state agency shall\nbe confidential, and their disclosure to anyone other than a state or federal official is\nprohibited. The privilege of confidentiality given under this secti on does not apply to an\nagriculture operation's application for financial assistance from the soil erosion and water\nquality cost share program. The confidentiality given under this section shall not preclude\ndisclosure of an agriculture operation's agricu lture water quality plan to the Agriculture\nWater Quality Authority pursuant to a request by the authority for the purpose of the\nauthority carrying out its statutory duties. In a civil or administrative proceeding, after a\nprivate review consistent with t he Kentucky Rules of Civil Procedure, all documents\nclaimed confidential under this section shall be disclosed if the court or hearing officer\ndetermines that the documents claimed confidential show evidence of noncompliance\nwith this chapter or with appli cable federal, state, or local law. The party asserting the\nprivilege of confidentiality shall have the burden of showing that the privilege is properly\nasserted. If any person engaged in an agriculture operation is deemed a \"bad actor\" under\nKRS 224.71-130(2), the privilege of confidentiality given under this section to documents\nrelating to the bad actor's agriculture operation shall be lost. The confidentiality granted\nby this section shall not prohibit disclosure of statistical information not descripti ve of\nany identifiable agriculture operation or person. Nothing in this section shall prohibit\ndisclosure of agency reports, monitoring or sampling data, and other information\ncontained in state or local conservation district files relating to water qualit y compliance\nand investigations or notices under KRS 224.71-130.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10529","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"2cf1ddf56145a0e0c604441fd4bcb8885da56239c7a0e79736b0eefa2941e653","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.71-130","next":"us-ky/krs-224.71-140"},"notice":"GroundRules: Original legal text.
