{"data":{"id":"us-ky/krs-224.73-100","jurisdiction":"us-ky","citation":"KRS 224.73-100","heading":"Sewage treatment company may condemn rights -of-way -- Approval","body":"required -- Objections.\nAny corporation authorized to do business in this state and organized for the purpose of\nconstructing, maintaining and operating sewer lines and sewage treatment  facilities may,\nif it is unable to contract or agree with the owner after a good faith effort to do so,\ncondemn rights -of-way necessary for constructing, maintaining and operating its\npipelines and, if necessary, pumping stations; and the necessary ingres s and egress to\nexamine, alter, repair and maintain such pipelines. The condemnation proceedings shall\nbe conducted in the manner provided in the Eminent Domain Act of Kentucky. Provided,\nhowever, that before any corporation shall be authorized to use the provisions of this\nsection, it shall have presented plans and specifications to the Energy and Environment\nCabinet and received from said cabinet a permit to operate and maintain said sewage\ntreatment facilities together with an approval of the discharge o f the treated effluent from\nsaid facilities to a specific point of the waters of this Commonwealth. Provided, further,\nthat any person wishing to object to a pipeline or plant location subject to the provisions\nof this section shall have the right to have his objections heard by said cabinet pursuant to\nthe provisions of KRS 224.10-440.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10532","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"dc10e46f11e84f6927c441e3de43e474357532ea2c8f15077ff8e035aa9b68c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.725","next":"us-ky/krs-224.73-110"},"notice":"GroundRules: Original legal text.
