{"data":{"id":"us-ky/krs-224.73-110","jurisdiction":"us-ky","citation":"KRS 224.73-110","heading":"Duties of Kentucky Board of Certification of Water and Wastewater","body":"System Operators -- Examination and certification of operator -- Classification\nof systems -- Fees -- Training required for certificate renewal -- Waiver.\n(1) The Kentucky B oard of Certification of Water and Wastewater System Operators\nestablished in KRS 224.10-024 shall recommend qualified applicants to the cabinet\nfor certification and perform other acts as may be necessary to carry out the\npurposes of this section.\n(2) No person shall have primary responsibility for the operation of any sewage system\nor portion thereof whether publicly or privately owned unless:\n(a) The person has passed an examination prescribed by the Energy and\nEnvironment Cabinet and board which shall d etermine the person's skill and\ncompetency for the operation and has been issued a certificate to that effect by\nthe cabinet; or\n(b) The person is operating a sewage system located at the residence where the\nperson lives and the sewage system serves only one (1) residence.\n(3) No person shall authorize or allow any person who does not hold a certificate issued\npursuant to subsection (2) of this section to have primary responsibility for the\noperation of any sewage system or portion thereof.\n(4) The cabinet, with the advice of the board of certification, may classify all sewage\nsystems and portions thereof in the manner provided by the rules and regulations of\nthe cabinet with regard to size, type, physical conditions affecting such systems or\nportions thereof, and the skill, knowledge and experience required for the operation\nof the system or portion thereof and restrict the application of any certificate issued\npursuant to subsection (2) of this section to the operation of a sewage system or\nportion thereof of a specific class.\n(5) Any person who has primary responsibility for the operation of a sewage system for\na school shall be entitled to a limited certificate of competency for his particular\nsystem, provided he has demonstrated that he has the knowledge and experience\nrequired to operate properly the particular sewage system for which he is\nresponsible. A limited certificate of competency so issued is not transferable to any\nother sewage system, nor is the period of operation under such a limited certific ate\neligible for consideration toward the experience requirements for a certificate of\ncompetency as provided in subsection (2) of this section.\n(6) All applicants for the examination and certification for the operation of any sewage\nsystem or portion ther eof, whether publicly or privately owned, shall pay a\nreasonable schedule of fees and charges fixed by regulation. The fees required\nunder this section shall be payable to the cabinet.\n(7) Operators shall have accumulated a minimum number of hours of appropriate board\napproved training set by regulation for certificate renewal. Such training shall\ninclude, but may not be limited to, correspondence courses, short courses, trade\nassociation meetings, and on -the-job training. Training hours accumulated in any\ngiven year in excess of the minimum requirement necessary for renewal may be\ncarried forward for a period not to exceed two (2) years.\n(8) The board may waive any or all of the requirements of subsection (7) of this section\nfor all or portions of an established class of operators.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55570","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"2900dd9babb17aa1ffeb1994c06081660b3f2a956c54294ee6b3a33a7e8ce47d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.73-100","next":"us-ky/krs-224.73-120"},"notice":"GroundRules: Original legal text.
