{"data":{"id":"us-ky/krs-224.80-130","jurisdiction":"us-ky","citation":"KRS 224.80-130","heading":"Information, restrictions, and requirements to be included in","body":"environmental covenant.\n(1) An environmental covenant shall:\n(a) State that the instrument is an environmental covenant executed pursuant to\nKRS 224.80-100 to 224.80-210;\n(b) Contain a l egal description of the real property and a metes and bounds\ndescription of the portion of the real property;\n(c) Describe the activity and use limitations imposed on the real property;\n(d) Identify every holder;\n(e) Be signed by the cabinet, by every hold er, and, unless waived by the cabinet,\nby every owner of an interest in the real property subject to the environmental\ncovenant; and\n(f) Identify the name and location of any administrative record for the\nenvironmental response project.\n(2) In addition to the information required under subsection (1) of this section, an\nenvironmental covenant may contain other information, restrictions, and\nrequirements agreed to by the persons who signed it, including:\n(a) Requirements for notice following transfer of a sp ecified interest in, or\nconcerning proposed changes in use of, application for building permits for, or\nproposals for any site work affecting the contamination on, the property\nsubject to the covenant;\n(b) Requirements for periodic reporting describing compliance with the covenant;\n(c) Rights of access to the property granted in connection with implementation or\nenforcement of the covenant;\n(d) A brief narrative description of the contamination and remedy, including the\ncontaminants of concern, the pathways  of exposure, limits on exposure, and\nthe location and extent of the contamination;\n(e) Limitation on amendment or termination of the covenant in addition to those\ncontained in KRS 224.80-180 and 224.80-190; and\n(f) Rights of the holder in addition to the holder's right to enforce the covenant\npursuant to KRS 224.80-200.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10538","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"abffc8a993331503eafa66f7226c1a5c48492c5806febe3fa6dfb89fdd288056","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224.80-120","next":"us-ky/krs-224.80-140"},"notice":"GroundRules: Original legal text.
