{"data":{"id":"us-ky/krs-224a.060","jurisdiction":"us-ky","citation":"KRS 224A.060","heading":"Authority is taxing district -- Power to levy taxes.","body":"The authority is hereby declared to constitute an independent taxing district within the\nmeaning of the Constitution of the Commonwealth of Kentucky, which authority, as an\nindependent taxing district, shall encompass the entire geographical area of the\nCommonwealth of Kentucky. The General Assembly finds and determines as a legislative\nfinding of fact that the use of water in any manner tending to contaminate it creates a\npollutant, and that the public health, safety, and welfare of the citizens of Kentuck y will\nbest be served by the proper disposition thereof according to the highest public health\nstandards. The carrying out of such objectives serves a statewide public purpose, not\nrelated to any specific area or locality of the state, but affecting the we lfare and health of\nall Kentucky citizens and the future of the state, both functionally and economically. The\nauthority, upon resolution duly adopted by its governing body, as an independent taxing\ndistrict within the Commonwealth of Kentucky, may levy an d collect a tax upon every\npurchase of water service or sewer service in the Commonwealth of Kentucky, such tax\nto be equal to not more than two percent (2%) of the gross amount of each such purchase\nof water service or sewer service. All of such utility t ax receipts shall, upon receipt, be\nand constitute authority revenues, and may be used, treated and applied by the authority in\ncommon with other authority revenues, to carry out the purposes for which the authority\nis created, including payment of princip al and interest on authority revenue bonds;\nprovided, however, that in connection with the issuance of authority revenue bonds, the\nauthority may pledge such utility tax receipts for bond amortization purposes only to the\nextent same may be actually levied , collected, and received by the authority, and to the\nextent same are not otherwise committed or budgeted by the authority during any fiscal\nperiod of the authority, and no covenant shall be made by the authority for the\ncontinuation of such utility tax i n futuro, without the requisite vote required by the\nprovisions of the Constitution of the Commonwealth of Kentucky.","path":["KRS Chapter 224A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10559","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"4ae94ea92a3586f0ea7c9ed6218715d675badeb0bf5960d3ced3d51f4a243e63","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224a.055","next":"us-ky/krs-224a.070"},"notice":"GroundRules: Original legal text.
