{"data":{"id":"us-ky/krs-224a.117","jurisdiction":"us-ky","citation":"KRS 224A.117","heading":"Kentucky BEAD Grant Program -- Purpose -- Powers of office --","body":"Application of federal law -- Grantee applications for funding.\n(1) The Kentucky BEAD Grant Program is hereby established for the purpose of\ndefraying eligible expenses associated wit h projects intended to provide broadband\nservice to unserved and underserved areas of the Commonwealth, and, to the extent\nfunding is available, for certain nondeployment purposes allowable under federal\nlaw. This program shall be the exclusive means of di stributing BEAD Program\nmoney to Kentucky applicants.\n(2) The office is hereby authorized, consistent with the requirements of this section, to\nadminister the Kentucky BEAD Grant Program. It shall have all power necessary\nand convenient, not explicitly pro hibited or reserved by statute, to carry out and\neffectuate its purposes, including the powers to:\n(a) Develop and submit BEAD Program funding requests to the administration or\nother responsible federal entities;\n(b) Conduct a challenge process consistent with federal requirements to identify\nKentucky locations eligible for funding;\n(c) Develop an application process for applications for funding from the\nKentucky BEAD Grant Program, including the requirements for the\napplications, in a manner that does not violate the prohibition in KRS\n278.5462(1);\n(d) Determine eligibility criteria for prospective subgrantees and projects;\n(e) Create rules governing the review process and timeline for applications and\nchallenges to those applications;\n(f) Make administrative rules necessary for the achievement of the goals of the\nKentucky BEAD Grant Program;\n(g) Coordinate and partner with local governments or private entities as\nnecessary;\n(h) Determine which grant applications should receive funding and disburse those\ngrants from the BEAD fund established in KRS 224A.118;\n(i) Enter into contracts or agreements necessary or incidental to the performance\nof its duties, functions, and responsibilities;\n(j) Notwithstanding KRS 45A.190, require applicants to submit letters of credit,\nbonds, or other reasonable means of assuring project c ompletion it deems\nappropriate and necessary, including giving full effect to the guidance from\nthe administration by allowing the office to provide grantees a range of\noptions to satisfy this paragraph;\n(k) If funding is available after identifying and fu nding BEAD Program\ndeployment projects, identify and fund nondeployment projects consistent\nwith federal law;\n(l) Oversee and administer reporting and compliance under grants made under\nthe Kentucky BEAD Grant Program consistent with federal law; and\n(m) Act as otherwise necessary to pursue the goals of the Kentucky BEAD Grant\nProgram.\n(3) Except where explicitly stated otherwise, all terms in this section shall have the\nsame meaning as provided in the Infrastructure Investment and Jobs Act, Pub. L.\nNo. 117 -58, and in the Notice of Funding Opportunity for the BEAD Program\npublished by the administration on May 13, 2022, including any subsequent\nguidance issued by the administration with respect to the program after the issuance\nof the Notice of Funding Oppor tunity. In the event of any conflict between this\nsection and legal requirements contained in the federal law, the federal law shall\ntake precedence. To the extent this chapter conflicts with any other provision of the\nKentucky Revised Statutes, this chapter prevails.\n(4) The office shall ensure that applications contain sufficient information to allow the\noffice to reasonably evaluate each grantee's ability to comply with all program\nrequirements, including all grantee qualifications and conditions require d under\nfederal law.\n(5) KRS 224A.1121 shall not apply to the Kentucky BEAD Grant Program as\ncontained in KRS 224A.115 to 224A.118.","path":["KRS Chapter 224A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54506","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:42Z","sha256":"d0861658e817c8c9081ee35e6f10eb8ad2a68934c58ce14b92f46a7fbe02d739","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224a.116","next":"us-ky/krs-224a.118"},"notice":"GroundRules: Original legal text.
