{"data":{"id":"us-ky/krs-224a.316","jurisdiction":"us-ky","citation":"KRS 224A.316","heading":"Legislative findings -- Program implementation -- Priority to regional","body":"projects.\n(1) In furtherance of the goal of making access to public water and wastewater systems\nmore resilient and available to the public, the General Assembly finds an d declares\nthat governmental agencies should provide to water and wastewater systems the\nrequisite financial resources to:\n(a) Develop the technical, managerial, and operational expertise needed to\nproperly operate and maintain their drinking water and wastewater systems;\n(b) Conserve, protect, and maximize the resources needed to offer drinking water\nand wastewater systems and services;\n(c) Upgrade drinking water and wastewater systems and services to prevent water\nloss and inflow and infiltration from degrading infrastructure; and\n(d) Leverage existing finance with anticipated federal dollars or with other\nsources as may be available from time to time to create a larger pool of\nfinance for water and wastewater systems to make improvements while\nkeeping customer rates affordable.\n(2) The Kentucky Infrastructure Authority shall implement a program to assist\ngovernmental agencies that provide drinking water and wastewater services with\nthe financial resources for both capital and non -capital expenses, includin g but not\nlimited to:\n(a) Developing technical, operational, and maintenance resources and expertise;\n(b) Improving utility infrastructure planning, repair, maintenance, renovation, and\nmanagement of plants and assets;\n(c) Obtaining technical expertise in areas of rate -setting, cost -of-service, and\nproper utility accounting standards for the utility type;\n(d) Performing and correcting deficiencies from drinking water, wastewater, and\nfinancial audits;\n(e) Providing finance for financial inadequacies, including debt service coverage\nthrough relief or refinance of the drinking water or wastewater system's debt;\n(f) Payment assistance for other financial inadequacies such as excessive\nmaintenance costs, fines and penalties from past violations, or consultants;\nand\n(g) Extending finance for inadequately maintained distribution, collection, or\ntreatment works, including service extensions to unserved or underserved\nareas and the renovation of treatment works to conserve resources.\n(3) The authority shall give priority for projects that are regional in nature and achieve\nthe purposes set out in KRS 224A.300, including but not limited to projects\ndesigned to correct state or federal deficiencies of a public water or  wastewater\nsystem that is being acquired as described in KRS 65.058, but only during the\nforbearance period granted to the acquired public water or wastewater system under\nthat section.","path":["KRS Chapter 224A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54596","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"276824dcf1ef0058c8ffbded6d2234d75cb3a1cf0c7d7a97c422628d28420bc9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224a.314","next":"us-ky/krs-224a.318"},"notice":"GroundRules: Original legal text.
