{"data":{"id":"us-ky/krs-224a.325","jurisdiction":"us-ky","citation":"KRS 224A.325","heading":"Emergency Kentucky water and wastewater assistance for troubled or","body":"economically restrained systems fund.\n(1) The emergency Kentucky water and wastewater assistance for troubled or\neconomically restrained systems fund is hereby established in the  State Treasury\nand shall be administered by the authority.\n(2) The fund shall be a dedicated revolving fund, and all moneys in the fund shall be\ndedicated to providing funding for both capital and non -capital expenses relating\nsolely to restoring or avoiding imminent interruption of utility service provided by a\npublic water or wastewater system after a statewide state of emergency has been\ndeclared pursuant to KRS Chapter 39A or a local state of emergency has been\ndeclared for the jurisdiction where the p ublic water or wastewater system is located\npursuant to KRS Chapter 39B.\n(3) The authority may require a public water or wastewater system to include with its\napplication for funding under this section a corrective action plan detailing how the\napplicant plans to address any performance deficiencies that may have given rise to\nthe need for the requested funding.\n(4) Interest rates for loans awarded pursuant to this section shall be set using the same\ncriteria to set the interest rates for loans from the fed erally-assisted water supply\nrevolving fund administered by the authority under KRS 224A.1115 and the\nfederally-assisted wastewater revolving fund administered by the authority under\nKRS 224A.111.\n(5) (a) The fund may receive donations, gifts, state approp riations, repayments from\nthe funding provided under subsection (2) of this section, and revenues or\nproceeds from the sale of bonds or from other financial instruments.\n(b) The fund may receive proceeds from the authority's infrastructure revolving\nfund under KRS 224A.304, as available, if:\n1. Not contrary to the requirements which establish and govern the\nmanagement and use of those funds; and\n2. The proceeds do not contain any federal moneys.\n(c) Any interest earnings of the fund shall become a part of the fund and shall not\nlapse.\n(6) Notwithstanding KRS 45.229, moneys in the fund shall not lapse but shall be\ncarried forward to the next fiscal year and used solely for the stated purposes in this\nsection.","path":["KRS Chapter 224A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54594","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"d056f71c11892d5665f7be2a336782d062cda50a24a6ddb6c3fc35e10fc61467","source_id":"us-ky","stale":false,"prev":"us-ky/krs-224a.322","next":"us-ky/krs-226.010"},"notice":"GroundRules: Original legal text.
