{"data":{"id":"us-ky/krs-226.040","jurisdiction":"us-ky","citation":"KRS 226.040","heading":"Pawnbroker to keep register of loans and purchases -- Report to online","body":"transaction recording service accessible to law enforcement -- Information to\nbe included in register -- State officers may inspect -- Holding period before\nresale -- Release of stolen property to law enforcement.\n(1) Every pawnbroker shall keep a register of all loans and purchases of all articles by\nthe pawnbroker from the general public. The register shall:\n(a) Be reported to an online, Internet -based transaction recording  service\naccessible to law enforcement agencies;\n(b) Show the dates and the amounts of all loans or purchases by the pawnbroker\nfrom the general public, and the names and:\n1. A driver's license number;\n2. Another state or federally issued picture identification card number; or\n3. If the identification specified in subparagraph 1. or 2. of this paragraph\nis not available, a Social Security number may be accepted;\nof all persons who have left any property that has been pawned or sold;\n(c) At all times be ava ilable to the inspection of any law enforcement officer of\nthis state when in the discharge of his or her official duty; and\n(d) Contain a full description of all property purchased by the pawnbroker from\nthe general public or received on deposit as collat eral or security. When\nrequested by law enforcement and pertaining to an investigation, a photograph\nof the merchandise shall be made available to law enforcement if the property\nis still in the possession of the pawnbroker. For purposes of this paragraph,\n\"full description\" includes but is not limited to:\n1. Make;\n2. Model;\n3. Color;\n4. Size;\n5. Manufacturer;\n6. Vintage; and\n7. Distinguishing marks or characteristics.\n(2) When secondhand merchandise is sold to a pawnbroker, the merchandise shall be\nheld for a minimum of twelve (12) days before being resold.\n(3) Prior to the release of property to a representative of law enforcement, the law\nenforcement representative shall provide to the pawnbroker a cas e report or other\ndocumentation that the item has been reported as stolen.","path":["KRS Chapter 226"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47486","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"a8edde03bdc358ccc1dd0910f95127b63774494a94d6cbbc9e6afe32dca5cbeb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-226.030","next":"us-ky/krs-226.050"},"notice":"GroundRules: Original legal text.
