{"data":{"id":"us-ky/krs-227.220","jurisdiction":"us-ky","citation":"KRS 227.220","heading":"Duties of state fire marshal and chief state building official relating to fire","body":"loss.\n(1) The state fire marshal shall enforce or aid in the enforcement of all laws,\nadministrative regulations, and ordinances of the state and its political subd ivisions\nrelating to fire loss as defined in KRS 227.200:\n(a) The prevention or reduction of loss by fire or by other hazard or risk insured\nby property or casualty insurance companies doing business in this state,\nexcept as to disability insurance and wor kers' compensation, and shall enforce\nany other regulations or methods adopted for the prevention of loss from such\nhazards or risks in order to promote the safety of persons or property;\n(b) The manufacture, transportation, storage, sale, or use of combus tibles,\nexplosives, and hazardous materials or equipment;\n(c) The design, construction, and maintenance of property which has a direct\nbearing on safety to life and property;\n(d) The construction, installation, maintenance, or equipment of fire alarm\nsystems, fire protection and extinguishing equipment, and fire escapes and\nother means of access to or exit from property; and\n(e) Arson and related offenses.\n(2) The chief state building official shall enforce and administer all applicable\nprovisions of the Kentucky Building Code, including all the provisions designed for\nthe prevention of fire loss, and shall have all the powers and duties awarded by KRS\nChapter 198B and the Kentucky Building Code.\n(3) The state fire marshal is authorized to:\n(a) Investigate the cause, origin, and circumstances of fires and explosions for the\npurpose of detecting and suppressing arson and related offenses, or for the\npurpose of minimizing or preventing fire loss;\n(b) Supervise and make periodic inspections of all property withi n the state, and\nassist cities having fire departments in making like periodic inspections of all\nproperty in cities, except occupied private dwellings;\n(c) Issue and enforce reasonable emergency orders and orders in accordance with\nKRS 227.330 for the pre vention of fire loss, and for the adoption, approval,\nand installation of safety measures, remodeling, and equipment as will\nminimize fire loss;\n(d) Provide technical and engineering advice and assistance to state and local\ngovernmental agencies in relation to fire prevention or fire protection;\n(e) Direct and assist owners of educational institutions, places of public assembly,\ninstitutional buildings, public buildings, factories, business buildings, or other\nplaces where persons congregate, in the instruc tion of fire prevention, and the\nholding of fire drills;\n(f) Conduct fire prevention and educational campaigns;\n(g) Conduct examinations into the cause, origin, or circumstances of fire losses;\n(h) Hold administrative hearings in accordance with the KRS Chapter 13B, as\nmay be required by law or deemed by the state fire marshal necessary or\ndesirable as to any matter within the scope of this chapter. All administrative\nhearings shall be public, unless  the state fire marshal, or an authorized\ndesignee, determines that a private hearing would be in the public interest, in\nwhich case, and only with the consent of all parties to the hearing, the hearing\nshall be private;\n(i) Direct research in the field of  fire protection and accept gifts and grants for\nthese purposes;\n(j) Appoint deputy fire marshals to be fire investigators; and\n(k) Recommend curricula for advanced courses and seminars in fire science\ntraining in colleges and institutions of higher education.\n(4) The state fire marshal shall head the Division of Fire Prevention in the department.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48430","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"ee62d88f79a80d2447a679e0f9f8c8a819008f7707a314fbb3ae2fd74a8516a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.210","next":"us-ky/krs-227.223"},"notice":"GroundRules: Original legal text.
