{"data":{"id":"us-ky/krs-227.280","jurisdiction":"us-ky","citation":"KRS 227.280","heading":"Subpoena and oath -- Production of evidence -- Conduct of examinations --","body":"Contempt.\n(1) The state fire marshal may subpoena witnesses; may administer oaths; may require\nthe production of books, papers, accounts, documents, and other records or\nmaterials of an evidentiary nature; and may examine witnesses in any investigation\nor other fact-finding proceeding authorized under this chapter.\n(2) Examinations may be public or private. Persons other than those required to be\npresent may be excluded from the place where the examination or investigation is\nheld, and witnesses may be kept separate and apart from each other and not allowed\nto communicate with each other until they have been examined.\n(3) If any person fails to respond to a subpoena, or refuses to  be sworn, or refuses to\ntestify, or fails or refuses to produce any record or material called for, or fails or\nrefuses to comply with a lawful order of the fire marshal or any deputy fire marshal\nor performs any contemptuous or contumacious act after being summoned to appear\nin connection with an investigation or fact -finding proceeding authorized under this\nchapter, the fire marshal or any deputy fire marshal, as the case may be, shall certify\nthe facts to the Circuit Court of the county in which the offe nse was committed.\nThat court shall have jurisdiction to hear, try, and punish these persons as in other\ncases of contempt.\n(4) The same fees shall be paid for the service of process, for the taking of depositions,\nand for the services of stenographers as is provided for like services in Circuit\nCourt.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10642","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"eee60194dac47694b8fb81186d723a0f5962aaedff0917964a8d16ef31c15983","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.275","next":"us-ky/krs-227.290"},"notice":"GroundRules: Original legal text.
