{"data":{"id":"us-ky/krs-227.300","jurisdiction":"us-ky","citation":"KRS 227.300","heading":"Standards of safety -- Conformance  with Uniform State Building","body":"Code  -- Publication of guidelines -- Participation in drafting standards by\ninstitutions offering infant and  preschool  care  -- Supplemental\nregulations on temporary change of use.\n(1) The  commissioner shall promulgate reasonable administrative regulations\nbased on good engineering practice and principles as embodied in recognized\nstandards of fire prevention and protection, providing for a reasonable degree\nof safety for human life against the exigencies of fire and panic, and insuring as\nfar as is practicable against fire loss. Such rules and regulations shall be\nknown  as the standards of safety. After promulgation of the Uniform State\nBuilding Code, no part of the standards of safety shall establish, in whole or in\npart, any building code other than the Uniform State Building Code, but the\ncommissioner may supplement the Uniform State Building Code with fire safety\nregulations designed to operate in conjunction with the code.\n(2) In making such administrative regulations the commissioner shall establish\nminimum  fire prevention and protection requirements, including but not limited\nto  requirements for design, construction, installation, operation, storage,\nhandling, maintenance, or use of the following: structural requirements for the\nvarious types of construction; building restrictions within congested districts;\nexit facilities from structures; fire alarm systems and fire extinguishing systems;\nfire emergency drills; maximum  occupancy loads and other requirements for\nbuildings of public assembly; flue and chimney construction; heating devices;\nboilers and pressure vessels; electrical wiring and equipment; air conditioning,\nventilating and other duct systems; refrigeration systems; flammable liquids, oil\nand  gas wells; garages, repair, and service shops; application of flammable\nfinishes, acetylene, liquefied petroleum gas, and similar products; calcium\ncarbide and acetylene generators; dry cleaning and dyeing plants; flammable\nmotion picture film; combustible fibers; airports and airport buildings; hazardous\nchemicals; rubbish; open flame devices; parking of vehicles; dust explosions;\nlightning protection; and other special fire hazards.\n(3) For the purpose of integrating the need for safety from hazards of fire with the\nother safety needs of infants or preschool children under institutional care, the\ncommissioner shall allow persons who  own, manage,  or are employed by\ninstitutions which provide care or education for infants or preschool children to\nparticipate in drafting the standards of safety as they apply to such institutions.\nSuch  participation shall be by representation of professional associations\nrelating to infant and  preschool care, and  by representation from other\nindividuals licensed to provide infant and preschool care, on a committee\nchaired by the state fire marshal or his or her designate. Such participation\nshall occur prior to the publication of proposed regulations in the administrative\nregister pursuant to KRS  13A.050 but shall not limit any individual's right to use\nthose procedures set forth in KRS  Chapter 13A concerning comment  on or\nprotest of proposed regulations. All professional associations relating to infant\nand preschool care shall be notified by the commissioner when the drafting of\nstandards of safety relating to such institutions is commenced  and all such\nprofessional associations shall be regularly notified of the time and place of any\nmeetings  conducted by authorized employees  of the department for the\npurpose of drafting such standards.\n(4) The  commissioner shall publish guidelines relating to the standards of safety\nas they apply to day care and preschool child care centers and nurseries which\nshall indicate the items inspectors from the Division of Fire Prevention will be\nlooking for when they conduct inspections pursuant to the standards of safety.\nSuch  guidelines shall be made  available to persons who  own, operate, or\nmanage  such centers or nurseries and shall be designed to enable said\npersons to anticipate and comply with the requirements of the standards of\nsafety.\n(5) The  commissioner shall issue supplemental regulations addressing the\ntemporary change of use in buildings as authorized by KRS  Chapter 198B.\nThese  regulations shall establish specific standards for such use and shall be\ndesigned to operate in conjunction with the Kentucky Building Code.\n(6) Any  standards of safety or other regulations promulgated under this section\nshall be subject to the requirements of KRS 198B.030(8).","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46958","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:43Z","sha256":"14457b0700f6206f2e8c6819d8bc132379cec575c7b87480dbada53bd2bad123","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.290","next":"us-ky/krs-227.305"},"notice":"GroundRules: Original legal text.
