{"data":{"id":"us-ky/krs-227.336","jurisdiction":"us-ky","citation":"KRS 227.336","heading":"Findings -- Correction of violations -- Fees.","body":"(1) Whenever the state fire marshal or any deputy state fire marshal appointed or\nemployed by him or her makes any finding set forth in subsection (1) of KRS\n227.330, or finds any property in violation of any provision of KRS 227.200 to\n227.410 or any regulations adopted thereunder, in lieu of the order required in KRS\n227.330(1), he or she shall notify the owner or his or her agent in writing of such\nspecific finding and violation and instruct him or her to correct the violation within\na period of time not to exceed sixty (60) days. Should the owner fail to make the\nrequired corrections within the specified time, the state fire marshal may proceed to\ntake any other action authorized in this chapter.\n(2) If the state fire marshal or a deputy state fire marshal i s required to make additional\ninspections, beyond the initial inspection and one (1) follow -up inspection, to\ndetermine if the required corrections referred to in subsection (1) of this section\nhave been made, the state fire marshal or the deputy state fir e marshal shall assess a\nfee against the property owner to recover the cost of each additional inspection\naccording to the following schedule:\nThird inspection fee.......................................................................................$100.00\nFourth inspection fee.....................................................................................$200.00\nFifth and subsequent inspection fee..............................................................$500.00\n(3) Any fee collected under the pro visions of this section by the state fire marshal shall\nbe payable to the State Treasury and credited to the Division of Fire Prevention for\nthe operation of the general inspection program. Any fee collected under the\nprovisions of this section by a deputy  state fire marshal shall be payable to the fire\ndepartment conducting the inspection.\n(4) If during a follow-up inspection or any subsequent inspection for the same violation\nthe state fire marshal or a deputy state fire marshal finds an additional violat ion not\nfound during the initial inspection, such additional violation shall be treated as an\ninitial violation which the property owner shall have the opportunity to correct\nunder subsection (1) of this section prior to the assessment of a fee under subsection\n(2) of this section.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10654","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:44Z","sha256":"afd5a2f041dd5e1407ddd235cae3963401e25cac13472ada45ab413d89ad0ed8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.335","next":"us-ky/krs-227.340"},"notice":"GroundRules: Original legal text.
