{"data":{"id":"us-ky/krs-227.550","jurisdiction":"us-ky","citation":"KRS 227.550","heading":"Definitions for KRS  227.550 to 227.660, 227.990, and 227.992.","body":"As  used in KRS  227.550 to 227.660, 227.990, and 227.992, unless the context\nrequires a different definition:\n(1) \"Seal\" means  the United States Department  of Housing  and  Urban\nDevelopment seal for manufactured homes;\n(2) \"Class B1  Seal\" and  \"Class B2  Seal\" mean  seals issued pursuant to\nsubsection (1) of KRS 227.600;\n(3) \"Retailer\" means any person, firm, or corporation, who sells or offers for sale\ntwo (2) or more manufactured homes, mobile homes, or recreational vehicles in\nany consecutive twelve (12) month period. The term \"retailer\" shall not include:\n(a) A manufacturer, as defined in this section;\n(b) Any bank, trust company, or lending institution that is subject to state or\nfederal regulation, with regard to the disposition of its own repossessed\nmanufactured housing; or\n(c) A licensed real estate agent who acts as a negotiator between an owner\nand  a  prospective purchaser and  does  not acquire ownership or\npossession of manufactured homes for resale purposes;\n(4) \"Established place of business\" means  a fixed and permanent place of\nbusiness in this state, including an office building and hard surface lot of\nsuitable character and adequate facilities and qualified personnel, for the\npurpose of performing the functional business and duties of a retailer, which\nshall include the books, records, files, and equipment necessary to properly\nconduct such business, or a building having sufficient space therein in which\nthe functional duties of a retailer may  be performed. The place of business\nshall not consist of a residence, tent, temporary stand, or open lot. It shall\ndisplay a suitable sign identifying the retailer and his business;\n(5) \"Federal act\" means  the National Manufactured Housing Construction and\nSafety Standards Act of 1974, 42 U.S.C. secs. 5401 et seq., as amended, and\nrules and regulations issued thereunder;\n(6) \"Manufactured home\" means a single-family residential dwelling constructed in\naccordance  with the federal act, manufactured after June 15, 1976, and\ndesigned to be used as a single-family residential dwelling with or without a\npermanent  foundation when connected to the required utilities, and includes\nthe plumbing, heating, air conditioning, and  electrical systems contained\ntherein. The manufactured home  may also be used as a place of business,\nprofession, or trade by the owner, the lessee, or the assigns of the owner or\nlessee and may comprise an integral unit or condominium structure. Buildings\nthe construction of which is not preempted by the federal act are subject to\nbuilding code requirements of KRS Chapter 198B;\n(7) \"Factory-built housing\" means manufactured homes, mobile homes, or mobile\noffice units;\n(8) \"Manufacturer\" means  any person who  manufactures manufactured homes\nand sells to Kentucky retailers;\n(9) \"Mobile home\" means a factory-built structure manufactured prior to June 15,\n1976, which was not required to be constructed in accordance with the federal\nact;\n(10) \"Department\" means  the Department of Housing, Buildings, and Construction\nin the Public Protection Cabinet;\n(11) \"Recreational vehicle\" means  a vehicular type unit primarily designed as\ntemporary living quarters for recreational, camping, or travel use, which either\nhas its own motive power or is mounted on or drawn by another vehicle not\nrequiring a special permit for movement  on Kentucky highways. The basic\nentities are: travel trailer, camping trailer, truck camper, motor home, and park\nvehicle;\n(a) Travel trailer: A vehicular unit, mounted on wheels, designed to provide\ntemporary living quarters for recreational, camping, or travel use, and of\nsuch size or weight as not to require special highway movement  permits\nwhen  drawn by a motorized vehicle, and with a living area of less than\ntwo hundred twenty (220) square feet, excluding built-in equipment (such\nas wardrobes, closets, cabinets, kitchen units, or fixtures) and bath and\ntoilet rooms.\n(b) Camping  trailer: A  vehicular portable unit mounted  on wheels and\nconstructed with collapsible partial side walls which fold for towing by\nanother vehicle and unfold at the camp  site to provide temporary living\nquarters for recreational, camping, or travel use.\n(c) Truck campers: A portable unit constructed to provide temporary living\nquarters for recreational, travel, or camping use, consisting of a roof, floor,\nand sides, designed to be loaded onto and unloaded from the bed of a\npickup truck.\n(d) Park vehicle: A vehicle which:\n1. Is built on a single chassis mounted on wheels;\n2. Is primarily designed as temporary living quarters for seasonal or\ndestination camping  and  which may  be  connected to utilities\nnecessary for operation of installed fixtures and appliances;\n3. Has  a gross trailer area not exceeding four hundred (400) square\nfeet in the set-up mode; and\n4. Has  a gross trailer area not less than two hundred forty (240)\nsquare feet and is certified by the manufacturer as complying with\nthe  current ANSI  standard or the generally accepted industry\nstandard as adopted by the department through the promulgation of\nan administrative regulation.\n(e) Motor  home:  A  vehicular unit designed to provide temporary living\nquarters for recreational, camping, or travel use built on or permanently\nattached to a self-propelled motor vehicle chassis or on a chassis cab or\nvan which is an integral part of the completed vehicle;\n(12) \"Secretary\" means  the Secretary of the Federal Department of Housing and\nUrban Development; and\n(13) \"ANSI\" means the American National Standards Institute.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46965","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:44Z","sha256":"767f947c37a0d1ea45f2f96e6e8e7017fa6f8a18aa64668837749eaa9124b043","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.530","next":"us-ky/krs-227.555"},"notice":"GroundRules: Original legal text.
