{"data":{"id":"us-ky/krs-227.770","jurisdiction":"us-ky","citation":"KRS 227.770","heading":"Definitions for KRS 227.770 to 227.784.","body":"As used in KRS 227.770 to 227.784:\n(1) \"Cigarette\" means any roll for smoking, whether made wholly or in part of tobacco\nor any other substance, irrespective of size or shape, and whether or not the tobacco\nor substance is flavored, adulterated, or mixed with any other ingredient, the\nwrapper or cover of which is made of paper or any other substance or material\nexcept tobacco;\n(2) \"Manufacturer\" means:\n(a) Any entity which manufactures or otherwise produces cigarettes or causes\ncigarettes to be manufactured or produced anywhere that the manu facturer\nintends to be sold in this state, including cigarettes intended to be sold in the\nUnited States through an importer;\n(b) The first purchaser anywhere that intends to resell in the United States\ncigarettes manufactured anywhere that the original ma nufacturer or maker\ndoes not intend to be sold in the United States; or\n(c) Any entity that becomes a successor of an entity described in paragraphs (a)\nand (b) of this subsection;\n(3) \"Quality control and quality assurance program\" means the laboratory pr ocedures\nimplemented to ensure that operator bias, systematic and nonsystematic\nmethodological errors, and equipment -related problems do not affect the results of\nthe testing. The program shall ensure that the testing repeatability remains within\nthe required repeatability values stated in KRS 227.772(1)(f) for all test trials used\nto certify cigarettes in accordance with KRS 227.770 to 227.784;\n(4) \"Repeatability\" means the range of values within which the repeat results of\ncigarette test trials from a single laboratory will fall ninety-five percent (95%) of the\ntime;\n(5) \"Retailer\" means any person who sells to a consumer or to any person for any\npurpose other than resale;\n(6) \"Sale\" means:\n(a) Any transfer of title or possession or both, exchange or barte r, conditional or\notherwise, in any manner or by any means whatever or any agreement\ntherefor; and\n(b) The giving of cigarettes as samples, prizes, or gifts, and the exchanging of\ncigarettes for any consideration other than money;\n(7) \"Sell\" means an act of selling, or an offer or agreement to sell; and\n(8) \"Wholesale dealer\" means:\n(a) Any person who sells cigarettes or tobacco products to retailers or other\npersons for purposes of resale; and\n(b) Any person who acts as a \"nonresident wholesaler,\" \"resident wholesaler,\" or\n\"unclassified acquirer\" as defined in KRS 138.130, and who is authorized by\nthe Department of Revenue to purchase and affix tax stamps on packages of\ncigarettes.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10705","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:44Z","sha256":"10dee9a999922e412271633dab74f4dd3284b0142d0a2512fa4fd48eb82ff4cd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.752","next":"us-ky/krs-227.772"},"notice":"GroundRules: Original legal text.
