{"data":{"id":"us-ky/krs-227.990","jurisdiction":"us-ky","citation":"KRS 227.990","heading":"Penalties.","body":"(1) Except for manufactured homes manufactured under the federal act, any person who\nviolates any provision of this chapter or any provision of a lawful order, rule, or\nregulation made under the provisions of this chapter, or who induces another to\nviolate any  provisions of this chapter or of any lawful order, rule, or regulation\nmade thereunder, upon conviction thereof shall be fined not less than twenty -five\ndollars ($25) nor more than one thousand dollars ($1,000), or confined in the county\njail for not more  than sixty (60) days, or both. Each day such violations exist shall,\nin the discretion of the courts, be considered as a separate offense.\n(2) Any person who, for manufactured homes manufactured under the federal act,\nviolates any provision of the federal  act or of KRS 227.550 to 227.660 or any\nregulation or final order issued thereunder shall be liable for a civil penalty not to\nexceed one thousand dollars ($1,000) for each such violation. Each violation of a\nprovision of KRS 227.550 to 227.660 or of the federal act or any regulation or order\nissued thereunder shall constitute a separate violation with respect to each\nmanufactured home or mobile home or with respect to each failure or refusal to\nallow or perform an act required thereby, except that the max imum civil penalty\nmay not exceed one million dollars ($1,000,000) for any related series of violations\noccurring within one (1) year from the date of the first violation.\n(3) Any individual, or a director, officer, or agent of a corporation who knowingly and\nwillfully violates the federal act or KRS 227.550 to 227.660 in a manner which\nthreatens the health or safety of any purchaser shall be fined not more than one\nthousand dollars ($1,000) or imprisoned not more than one (1) year in the county\njail, or both.\n(4) Any person violating the provisions of KRS 227.702 to 227.750, the regulations\nissued thereunder, or any order issued thereunder, or who knowingly induces\nanother, directly or indirectly, to violate the provisions of those sections, shall be\nfined not more than one thousand dollars ($1,000), or imprisoned in the county jail\nfor not more than thirty (30) days, or both.","path":["KRS Chapter 227"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10715","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:44Z","sha256":"b901ae292db00b3824f8344b207c39d173dfc258af380e0ad64c9d870cc27596","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227.810","next":"us-ky/krs-227.991"},"notice":"GroundRules: Original legal text.
